Processing time for FLR (M) age review cases after Supreme Court ruling in Quila and Bibi in Oct 2011
Dear UK Border Agency,
The Supreme Court declared Paragraph 277 of the immigration rule unlawful in Nov 2011 in Quila Case. The rule was “if either the Applicant/Spouse is under 21 years old on the date of arrival in the United Kingdom then he/she will not be granted FLR (M) visa”. UK Government abolished this law & UKBA announced that it will review all cases that were refused a visa solely on age grounds alone, between 27 November 2008 and October 2011. The last date to receive these review applications (FLR M age review) was 31st of May 2012.
I would like to know for my benefit & for the benefit of other people who have suffered due to this law
1) As of 31st of May 2012, how many FLR (M) age review applications have been received to UKBA CLS 12 team in Sheffield ?
2) How many FLR (M) age review applications have been processed and how many are still outstanding for a final decision?
3) What is the average current waiting time for these review applications only & what was the average processing time for completed applications?
4) Has the UKBA got a dedicated team set-up review these applications & what is the strength of this team?
5) What is the legal maximum period of decision making under immigration law for FLR (M) age review cases and why these simple cases are taking almost an year to resolve it ?
6) What is the UKBA target date to finish the review of all these application received under FLR (M) age review category & Is UKBA currently achieving this target?

Thank you very much for the answers. This information is very useful & almost exactly what I was looking for. But I got some concerns about the information you have provided as my wife is one of the applicant under this category.
You have mentioned under point (5) that “The longest time taken to resolve a case has been 3 months.” But my wife sent her application on 25th of Nov 2011 & she hasn’t received a decision on her application yet. It has now been more than 8 months.
Could you please inform us from CLS 12 team under freedom of Information act that the last remaining application is UKBA case reference number 014664511 & has been decided on 3rd of August 2012 as mentioned by you.

The last remaining application mentioned in my previous response is not reference number 014664511. It appears that there were 53 applications. Your wife's application has still to be decided. We will be contacting her shortly with an update on her case.
