Dear Home Office,

Article 5 of the citizens directive states that the family member of an eea national only needs to submit a valid passport. Passport/id of the union citizen and proof of family relationship.

Please provide any guidance you store which shows the process of issuing a family permit.

what happens if the applicant refuses to submit biometric data.

I previously read a request to Mr Shanderia which states that you request (and not require) the submission of biometric data.

What happens if the applicant refuses to submit biometric data?

You failed to answer the most important question of my request.

You do hold infomation on this, as your communication with the EC in 2012 outlined that failure to submit biometric details does not remove a persons rights.

Therefore, please respond to the query. Surely you hold the information requested, and if not, a response to the actual query outside of the scope of the FOI Act would be the best course of action.
