Processes prescribed under the Environmental Protection Act 1990

Department for Environment, Food and Rural Affairs did not have the information requested.

Dear Department for Environment, Food and Rural Affairs,

I am trying to find a definitive list of processes recognised as prescribed with respect to the Environmental Protection Act 1990.

I believe the definition of such processes is your departments responsibility, and I have been unable to find such a list.

Can you supply such a list, or tell me where one may be obtained?

Yours faithfully,

Paul Perrin

Processes prescribed under the Environmental Protection Act 1990

Dear Mr Perrin,

Many thanks for your email to the Defra Helpline. This has been forwarded
to my team to respond. You have asked Defra either for the list of
prescribed processes under the Environmental Protection Act 1990 or for
information on where you can obtain such a list. As the lists are
available in the public domain on the OPSI website we are providing you
with links to where you can find them rather than handling your request
formally under the Environmental Information Regulations 2004. I hope you
find this satisfactory.

The Environmental Protection (Prescribed Processes and Substances)
Regulations 1991 (SI1991/472) lists in Schedule 1 the descriptions of
process to which controls apply. This can be found at:

([1]http://www.opsi.gov.uk/si/si1991/Uksi_19...)

However you should be aware that these Regulations have been amended by a
number of amending regulations as follows:

SI1991/836 at [2]http://www.opsi.gov.uk/si/si1991/Uksi_19...

SI1992/614 at [3]http://www.opsi.gov.uk/si/si1992/Uksi_19...

SI 1993/1749 at
[4]http://www.opsi.gov.uk/si/si1993/Uksi_19...

SI 1993/2405 at
[5]http://www.opsi.gov.uk/si/si1993/Uksi_19...

SI 1994/1271 at
[6]http://www.opsi.gov.uk/si/si1994/Uksi_19...

SI 1994/1329 at
[7]http://www.opsi.gov.uk/si/si1994/Uksi_19...

SI 1995/3247 at
[8]http://www.opsi.gov.uk/si/si1995/Uksi_19...

A consolidated version of the prescribed processes and substances was
published by HMSO (HMSO, August 1994 ISBN 0117529990). This reproduces the
original regulations as amended by the subsequent six sets of amending
regulations, but it does not include SI 1995/3247 and is not an
authoritative text.

As you may be aware this list of prescibed processes is of is now of
historical significance only since they were revoked by the Environmental
Permitting Regulations (EPR) 2007. The EPR can be found at
([9]http://www.opsi.gov.uk/si/si2007/uksi_20... )

Guidance on the EPR can be found on the Defra website at;

[10]http://www.defra.gov.uk/environment/poli...

I hope that this information is of use to you.

Kind regards

David
