Proceeds of Crime Act

The request was successful.

Dear Equality and Human Rights Commission,

On the 18 April I made an FOI request to you that you kindly answered, see below.

I'm now interested in whether there have been any developments since then and if so could you supply me with the relevant information documentation.

Yours faithfully,

Michael Flood

18 April 2011

Dear Equality and Human Rights Commission,

I am wondering whether you have conducted any research or
investigation into the Proceeds of Crime Act 2002 or its
application to see if it conforms to equality and human rights. If
so, please supply copies of your research.

I am also wondering whether you have been requested to assist
people impacted by the POCA, the number of applications and the
sort of support you offered, in particular copies of any legal
arguments/submissions that you made.

Finally copies of any submissions or observations that you made on
the POCA to any other State or European bodies and replies that you
received.

Yours faithfully,

Michael flood

Might one ask why the response is posted in Welsh as there seems to be no requirement in the request to do so and we would suggest that such a posting prevents the wider audience from accessing the details of any reply.

I agree with the above language comment. I managed to translate the text using goggle language tool. Its mostly standard email disclaiming material however one gem it contained is 'The Commission is consulting on its strategic plan three years. The deadline for replying is 22 July 2011. The response is in English and Welsh. You have to click on "Show Quoted Text" to see the English bit, I think this is something to do with this site rather than the original response.

Our ref: FOI493

5th August 2011

Dear Mr Flood,

Update - Freedom of Information request: Reference FOI493 - Question 2

Further to our emails of 28th & 29th July 2011, we can now inform you that
the Commission has decided not to intervene in the forfeiture of cash case
being brought under the Proceeds of Crime Act. The main reason for this
decision was that the case does not have the potential for wide impact, so
it was not considered strategic.

I trust this answers your request, detailed in your email of 23rd July
2011, satisfactorily.

Kind regards
