Procedure for false details

Dear Transport for London,

A person that has been stopped on the London Underground for fare evasion by using a freedom pass not belonging to them and has given false details (name/address), what is your procedure to identify the persons correct details both immediately or thereafter?

if summons to court is sent to the 'false address' and person doesn't receive. does the trial continue?

about our fare evasion procedures.

 

Your request has been considered in accordance with the requirements of
the Freedom of Information Act and our information access policy. I can
confirm we do hold the information you require.

 

A person that has been stopped on the London Underground for fare evasion
by using a freedom pass not belonging to them and has given false details
(name/address), what is your procedure to identify the persons correct
details both immediately or thereafter?

 

We will make use of all means at our disposal to identify a suspect,
including use of CCTV, Oyster records of regular journeys, working with
partner agencies, credit reference data, tracing tools, etc.

 

If summons to court is sent to the 'false address' and person doesn't
receive. Does the trial continue?

 

A trial would continue if we were not made aware of prosecutions paperwork
being sent to a wrong address and an individual could be convicted.
Convictions are recorded against a named person with their date of birth
so conceivably they could be convicted even if they have given a false
address for the service of paperwork as long as the correct name and date
of birth are known.

in a previous response you stated

"A trial would continue if we were not made aware of prosecutions paperwork
being sent to a wrong address and an individual could be convicted.
Convictions are recorded against a named person with their date of birth
so conceivably they could be convicted even if they have given a false
address for the service of paperwork as long as the correct name and date
of birth are known."

would a trial continue and an individual convicted if you were provided with the wrong address and also made aware that prosecution paperwork is sent to a wrong address?

what would be the procedure when you find out that prosecution paperwork has been sent to the wrong address?

information about our fare evasion procedures.

 

Your request has been considered in accordance with the requirements of
the Freedom of Information Act and our information access policy. I can
confirm we do hold the information you require.

 

Each case depends on the specific circumstances and is decided on its own
merits. If we receive confirmation from an occupier of an address that
their address has been misused, which we are able to verify as genuine
using independent means e.g. Electoral Roll or Credit Reference Data etc.,
then we update our records accordingly. However if we identify that we are
being given false information for the purpose of trying to prevent a
legitimate service of court papers for prosecution purposes and the person
being prosecuted does actually live there then we would report this to
Police and the court as an attempt to pervert the course of justice. We
would make full efforts to identify the correct address for the passenger
being prosecuted, using tracing methods available to TfL as a Public
Prosecutor, and re-serve all paperwork at the correct address for the
passenger and proceed with the investigation/prosecution case
