I fully understand that not all police officers have the responsibility for submitting a case to be considered for prosecution at any level, including submitting cases for consideration to the CPS.

My request is limited to those within dyed Powys with a responsibility for policing policy; Therefore my specific question concerning Police procedure and constitutional law under the FO1 Act is.......As a matter of the prosecutions policy of Dyfed Powys Police, when considering submitting a case for prosecution, where applicable, does Dyfed Powys Police take into consideration Article 38 of the Magna Carta (1215).

This request would be confined to matter of policy rather than any individual police officer.

Dear FOI,

As the Magna Carta 1215 forms the founding principles of the British Constitution and the constitutions of most the the great western civilisation democracy.

The Administration of Justice Department (AoJ) has not right to ignore what is now firmly settled Constitutional law.

Therefore I wish to know under what legal precedent Dyfed Powys Police does not consider Article 38 Magna Carta 1215 in day-to-day procedures?

Also on what binding legal authority does Dyfed Powys Police base their processes solely upon statute legislation which has been passed through Parliament.

Director of Public Prosecutions as you right state exists for guidance, but this is not definitive only when applied to clandestine closed shop procedures!

Therefore I request an internal review under the FOI Act of my original request.

by Dyfed Powys Police on the 05 April 2011 where you request an internal
review of your original request, dated the 13 March 2011, under the
Freedom of Information Act.

In order that we can undertake the internal review process could you
advise me please what aspects of your Freedom of Information request you
wish us to review, as there is insufficient detail within your e-mail of
the 04 April 2011 for us to progress. If you choose not to respond then
we will be unable to progress the internal review process.

If you are dissatisfied with or have a complaint concerning the policies
set by the Force or the processes undertaken by the Force or a particular
department then details of the process for reporting dissatisfaction and
the complaints process are published on the Force website at the below

I believe that you are being evasive now as my FOI is really quite straight forward. You have responded thus-forth:-

The Administration of Justice Department (AoJ) has confirmed that Dyfed Powys Police does not
consider Article 38 Magna Carta 1215 in day-to-day procedures; Dyfed Powys Police base their
processes upon legislation which has been passed through Parliament.

Dyfed Powys Police uses the Director of Public Prosecutions guidance.

There my request for an internal review of you reply would be in order to establish precisely upon what authority is Art 38 of the Magna Carta 1215 not ta+ken into consideration.

Please do not use the well worn rejected reasoning of statute law as the Magna Carta 1215 is clearly beyond the reach of parliament

April 2011 requesting that Dyfed Powys Police review its response to
your request for information concerning the 'Magna Carta'.

My understanding is that the issues you have raised are that you wish to
establish "...precisely upon what authority is Art 38 of the Magna Carta
1215 not taken into consideration".

A review will be undertaken in line with the Code of Practice under s45
of the Freedom of Information Act 2000 and every effort will be made to
have a response to you by the 06 May 2011. However if it becomes clear

AFTER MUCH CONSIDERATION I AM NOT SATISFIED WITH YOUR EXPLANATION. REPLIES UNDER THE FOI ACT NEED TO BE SPECIFIC, THEREFOR KINDLY INFORM ME UNDER WHAT AUTHORITY DOES THE ADMINISTRATION OF JUSTICE DEPARTMENT CLAIM TO BE ACTING WHEN it confirmed that Dyfed Powys Police does not consider Article 38 Magna Carta 1215 in day-to-day procedures; and that Dyfed Powys Police base their processes upon legislation which has been passed through Parliament.. This of course implies that Dyfed Powys Police disregards common law ,and that surely cannot be correct.

I think it would be helpful to other requesters if you could add an annotation as to what happened after your communication with the Information Commissioner's Office (ICO). I do not know if you actually made the complaint to him or just received advice as you do not mention the complaint in your July 2011 communication to the Dyfed Powys Police.

From experience I have found that though the ICO may find that a request has not been handled appropriately they do not take the matter on but suggest the seeking of legal advice.
