Dear Merton Borough Council,

I would like to make an FOI regarding HMO’s and private rentals within London Borough of Merton.

Does Merton council consider a 3 Bed terraced house, with a downstairs room converted into a bedroom, occupied by 4 non related students, sharing 1 bathroom and kitchen as a HMO?

For a rental property in the borough of Merton would a landlord need to be formally registered as a landlord with Merton council?

Where can I check if a landlord is registered for a property in the borough of Merton?

How can I check if a landlord has a deposit in a tenancy deposit scheme (TDS) for a property in the borough of Merton.

What are the consequences if a landlord is not formally registered as a landlord and or does not have a deposit in a tenancy deposit scheme for a property in the borough of Merton?

What certifications needs to be passed on to tenants from a landlord in the borough of Merton.

Please supply the following Information in an excel spreadsheet for the latest information held to include:
a) addresses of all Registered Residential HMO properties that are within
your council's area
b) addresses of all Registered Residential properties that are within
your council's area
c) the number of bedrooms that each property referred to in (a) currently
has
d) the names/addresses of the owners/licence holders of those properties
referred to in (a)
e) any other details of the property that may be relevant

Our Response:

 

 1. Yes, this Scenario would make the property an HMO.
 2. There is no requirement to register the landlord however properties
which fall under the requirements of Mandatory, selective, and
additional licensing schemes are required to be licensed.
