Dear Mr Raeburn

FREEDOM OF INFORMATION ACT 2000 - request for information.

I acknowledge your request for information received on 20 August 2009.

Your request is being considered and you will receive a full response to
your request, within the statutory timescale of 20 working days (from
the day after the request is received) as defined by the Freedom of
Information Act 2000.

If appropriate, the information may be provided in paper copy, normal

The Act defines a number of exemptions, some of which are subject to a
public interest test that may prevent release of the information. You
will be informed if this is the case, and you have a right to appeal
against our decision. Information relating to this will be included in
any refusal notice issued.

Steve Walker, Hackney Borough Council

Dear Mr Raeburn,

Thank you for your email dated 14^th August 2009. I will respond to each
of your points in turn.

1. We do not hold any information / documents in relation to private hire
vehicles accessing bus lanes.

2. Section 12 of the Act states that the Council is not obliged to comply
with a request for information if the authority estimates that the costs
of complying with the request would exceed the appropriate limit. This
represents the estimated cost of one person spending 2½ working days in
determining whether the Council holds the information, and locating,
retrieving and extracting the information requested. Unfortunately your
request for copies of all traffic records relating to bus lanes is very
general and will require a thorough search for many older bus lane records
to ensure that all the available information on bus lanes is provided.
Currently, as there is no bus lane consolidation, this means the records
for each individual bus lane would need to be accessed. Consequently the
Council is not obliged under the Freedom of Information Act 2000 to
respond to your request where the information is held. I would ask that
you be more specific with regards to the information you are seeking. As
you may be aware Transport for London are responsible for any bus lane
orders on the highway which they manage and maintain.

If you are dissatisfied with this response and wish to appeal, please
write to the Information Governance Team, Appeals, 6-15 Florfield Road,
Hackney London E8 1DTand your complaint will be dealt with through our
Internal Review procedure.

If you are still not satisfied following the Internal Review, you have a
right to appeal to the Information Commissioner. He can be contacted at:

Information Commissioner's Office
Wycliffe House

Telephone: 01625 545 700

Yours Sincerely
