Further to our earlier correspondence dated 12/06/2017 I am now able to
provide a response to your complaint concerning Freedom of Information Act
(FOIA) request reference number: 2017040000271.  

Section 10(1) of the Freedom of Information Act 2000 states:

'Subject to subsections (2) and (3), a public authority must comply with
section 1(1) promptly and in any event not later than the twentieth
working day following the date of receipt.'

In the circumstances of your request, neither the information requested
nor a refusal notice was provided to you within 20 working days.
Therefore, the MPS have not complied with the requirements of section 10
of the Act.

I have made enquiries with the Information Manager (IM) with
responsibility for your request. A response is currently being drafted and
will be circulated to the business area concerned for quality assurance
purposes. The IM has advised that they anticipate that you should receive
a response within the next few days.

I have asked the IM to conclude your request as a matter of urgency and to
provide you with the response as soon as possible.

As a response to your request is currently outstanding, I am unable to
complete a full internal review in relation to your request. However,
should you be dissatisfied with the MPS response to your request, you may
request an internal review in relation to the decision.

SEARCHES TO LOCATE INFORMATION

To locate the information relevant to your request searches were conducted
within the MPS.

The searches located information relevant to your request.

DECISION

I have today decided to disclose the located information to you in full.

There have been 48 offences in the period (1 February 2016 - 28 February
2017) where Uber was referenced in a crime report for a Taxi and Private
Hire journey-related sexual offence in London.

Please note the following:
-       Taxi and Private Hire journey-related sexual offences include
crimes where a driver is alleged to have committed a sexual assault
against a fare paying passenger.
-       The information disclosed as part of this FOI is based on
information where an alleged Uber driver was named as a suspect in an
offence at one point in the investigation or there was reference to Uber
in the crime report. Not all suspects would have been charged with an
offence. They may not have been identified, have been eliminated from the
investigation (for example, the victim booked an Uber journey but got in
another vehicle) or there was insufficient evidence to charge them.
-       The information has not been verified against the TfL licensing
database to determine whether the driver was licensed at the time of the
offence, or whether the journey was booked through Uber.  Therefore this
information should not be taken as confirmation that the alleged incident
took place as part of a journey booked via the private hire operator Uber.
-       'Uber' is increasingly being used as a term by the public to refer
to minicabs and therefore the figures may include drivers that do not work
for Uber but the victim used this description in their report.
-       These figures are for the totals for London and will cover every
London Borough where an offence has taken place.
-       The MPS and TfL publish official figures for TPH journey-related
sexual offences against a fare-paying passenger in London at
https://tfl.gov.uk/corporate/safety-and-....
The figures include the total number of TPH journey-related sexual
offences as well as the total number of drivers charged with or summonsed
to court for a TPH-related sexual offence which are based on police data
and verified against TfL's Taxi and Private Hire Licensing database. For
these offences, the profile of the driver and the journey were known and
verified, and the police and the Crown Prosecution Service have determined
that there was sufficient evidence to charge the driver and for the case
to go before the Court. The official figures are updated and published
annually.
