FOI, Derby City Council

Dear Adam,

Thank you for your request received 14/03/19 under the Freedom of
Information  Act 2000 (FOIA) for private hire licencing.

Section 8(1)(b) of the Act requires that a request for information must
include the name of the requester.

However, in this instance the Council is not required to process your
request because it is not valid.

Your request is not valid because it only includes your first name in
isolation which does not meet the following requirements for a valid
request …

‘Any variation of the requester’s title or first name combined

with their surname (e.g. Mr Smith or John Smith) will be

sufficient to meet this requirement.  A first name or surname provided in
isolation, or a set of initials, will not’

However, we will consider your request if you provide your ‘first name and
surname’ and if we hold the information requested send you the response
within 20 working days unless an exemption applies.

Please contact us if you have any further queries or need help or advice

Please note, the following applies, if the response includes council
officers (or other officers) names.

If you are a company that intends to use the names and contact details of
council officers (or other officers) provided for direct marketing, you
need to be registered with the Information Commissioner to process
personal data for this purpose. You must also check that the individual
(whom you wish to contact for direct marketing purposes) is not registered
with one of the Preference Services to prevent Direct Marketing. If they
are you must adhere to this preference. You must also ensure you comply
with the Privacy Electronic and Communications Regulations (PECR). For
more information follow this Link [5]www.ico.org.uk

For the avoidance of doubt the provision of council (and other) officer
names and contact details under FOI does not give consent to receive
direct marketing via any media and expressly does not constitute a ‘soft
opt-in’ under PECR.

Yours sincerely,
