Dear Shepway District Council,
Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Shepway District Council's handling of my FOI request 'Princes Parade Working Group'.

While I appreciate that your response has indeed provided the minutes of the Working Group meetings, they contain no record whatsoever of any inputs from the members as would be expected to have been necessary to influence the Princes Parade development. For the Working Group to meet its obligations to “shape and influence the project proposal as it develops” it would surely be necessary to produce a record of what transpired at those meetings, such as recommendations, preferences or similar. Clearly also, reports (maybe in the form of presentations) would need to have been provided to the Working Group members. I ask that you please seek to provide copies of any reports/presentations and records of the key points raised by the members, since without more details the minutes provide absolutely no transparency of the project.
Further, it has come to my attention that on 16 Aug 2016 a meeting was held of an apparently new group, the Princes Parade Advisory Panel, which involved the same members of Cabinet, plus a few others, and addressed almost precisely the same material as would have been expected to be covered by the Princes Parade Working Group. If, as appears to be the case, that Advisory Panel subsumed the purposes of the Working Group – by making it unnecessary to hold a meeting of the latter – please provide a detailed record of that meeting or of any other meetings that served an equivalent purpose in shaping the course of the project.
As clarification of the purpose of my original request, I am please seeking transparency regarding the rationale for the Princes Parade development at a greater level of detail than has been made available for Cabinet meetings.

I acknowledge receipt of your application for a review of our response of
10 February 2017 to your Environmental Information Regulations request
(dated 8 February 2017).  We will be dealing with this by way of an
Internal Review in line with the procedure outlined in our response.  Your
request will be dealt with in accordance with Shepway District Council's
policy on such matters which is subject to guidance produced by the
Information Commissioner's Office in line with Regulation 11 of the EIRs
and the EIR Code of Practice.

 

We anticipate that the internal review will be completed within 20 working
days of your request, however in exceptional circumstances it may take
slightly longer. If this is the case with your enquiry, then we will
endeavour to notify you and explain why more time is needed.

the council’s decision on your original request made under the
Environmental Information Regulations 2004 dated 8 February 2017 as
follows:-

The council responded on 10 February 2017 with the information requested.

 

In your request for an internal review you state:-

An internal review consider the validity of the original decision and also
looks at whether circumstances have changed since that would lead to a
different response.

 

Turning first to the working group.  I can confirm that you have been
provided with all the recorded information the council hold on the meeting
of the working group.  I consider that the council’s response was correct
therefore.

 

Turning to the advisory group.  The recorded information that the council
holds in respect of meetings of the Princes Parade Advisory Group consist
of three PowerPoint presentations that the group received on 16 February
2016, 30 June 2016 and 6 March 2017.

·         I enclose the presentations made to the meetings of 16 February
and 30 June 2016.  However the council has decided to refuse your request
in respect of the presentation to the March meeting on the basis of the
exception contained in regulation 12 (5) (e) - cconfidentiality of
commercial or industrial information where such confidentiality is
provided by law to protect a legitimate economic interest.   The council
considers this to be commercially confidential to itself, that the
confidentiality is provided by law, protects a legitimate economic
interest and that disclosure would adversely affect the confidentiality. 
The council has carried out the public interest test and concluded that
maintaining the exception outweighs the public interest in disclosure. 
The council will shortly be engaged in promoting the development and
divulging the information may jeopardize its ability to obtain value for
money for the project and its negotiations with third parties.  The need
to maintain this confidentiality confidential outweighs other
considerations.
