Dear Shepway Council

The information within these bundles shows that there were a number of communications between Council officers and Tibbalds beyond those included in your response
In particular:-
1. Some of the emails between Tibbalds and Mr A Jarrett, Head of Strategic Development Sites, used a non Shepway District Council (SDC) email address for the latter, namely [email address]. Those exchanges appear to directly relate to the work to be undertaken by Tibbalds on Princes Parade. Contact between the two parties appears to have occurred prior to 7 Jan 2016 that has not been included in your response
Please therefore provide copies and records of ALL exchanges between SDC and Tibbalds, to include those that occurred prior to 7 January 2016 and those that used non SDC email addresses
2. Your response fails to include sufficient information to justify why Tibbalds, SPECIFICALLY, was selected as the Planning Application Consultant for this work bearing in mind that there appears to have been no significant overt interaction with the Company prior to their selection. Although you say that speed of delivery justified single-tender action, you must nonetheless have required the Company to provide sufficient information to justify THEIR selection.
Please provide the documentation that justified SDC selecting Tibbalds rather than other contenders I believe are known to possess sufficient prior knowledge of the site to meet the tight timescales (which in the event they failed to achieve)
3. Finally, I note that you are relying on regulation 12(5)(e) for refusing to release certain information.
Please confirm whether your reason for refusal satisfies ALL FOUR of the necessary criteria as laid out in Case Law; Bristol City Council v IC and Portland and Brunswick Squares Association (EA/2010/0012), failing which I understand the information being withheld should be released under the Environmental Information Regulations

13 February 2017 to your Environmental Information Regulations request
(dated 10 December 2016).  We will be dealing with this by way of an
Internal Review in line with the procedure outlined in our response.  Your

I refer to your request dated 6 March 2017 for an internal review of the
council’s response to your original request dated 10 December 2016.

 

Your original request was as follows:-

 

“Please provide the briefs/ instructions that have been given to Tibbalds 
in association with all work Tibbalds have undertaken in regard to the 
Princes Parade development together with related correspondence, meeting 
notes and notes on phone conversations.”

 

The council responded supplying the information albeit with the redaction
of some information on the ground of the exception contained in regulation
12(4)(d) of the Environmental Information Regulations 2004.

 

The internal review is an examination of the original decision and
handling of the request.

 

Your request for an internal review is as follows:-

There is no further  recorded information with Tibbalds on the Princes
Parade proposals.

I have informed the ICO that the council will provide you with the waivers
granted in respect of the contracts entered into with Tibbalds for a)
Planning and EIA Co – ordination Services and b) Planning Services.  I do
not consider that these documents fell within the scope of your request
but the council is willing to release them.  Accordingly they are
attached.

 

I also enclose copies of emails between Tibbalds and Mr. Jarrett using Mr.
Jarrett’s private email address.  These documents were not held by the
council at the time of your request (they were obtained on 11 September
2017 direct from Tibbalds) and so again did not fall within your request’s
scope, however they are being sent to you for completeness sake.

 

I will be sending a copy of this email and enclosures to the ICO.
