I am undertaking some research into the government PREVENT
programme (also previously known as "PVE - Prevent Violent Extremism").

I require the following information:-

1) The total budget for PREVENT in Blackburn with Darwen Borough Council for each year starting 2007 to present.

2) A list of organisations that have received PREVENT funding together with the amount and the main objective of the funding in each particular case.

3) Which council department is responsible for allocating PREVENT funding?

4) Is there a PREVENT focus/steering group? Who and what bodies does it consist of?

5) Please attach any documents/research that the council has
undertaken to assist its decison making process of allocation and areas to focus on.

6) What procedures/measures does the council undertake to ascertain the level of success in the intended objective of a particular PREVENT programme?

2007/08 - £100,000 (includes contribution to Pan-Lancashire work)

2008/09 - £185,000 (includes contribution to Pan-Lancashire work)

2009/10 - £225,000 (includes contribution to Pan-Lancashire work)

2010/11 - £225,800 (includes contribution to Pan-Lancashire work)

2011/12 - £90,850.00 (project delivery and support)

2012/13 - £155,103.00 (project delivery and support)

2. A list of organisations that have received PREVENT funding together with the amount and the main objective of the funding in each particular case.

I can confirm a public interest test took place on December 5th 2012 and the decision was made to withhold the information requested. Therefore the information you have requested is refused under Section 31 (1) (a) and (b) of the Freedom of Information Act 2000; Investigations and Proceedings conducted by Public Authorities. Full text as follows;

Section 31(1)(a) and (b) Information which is not exempt information by virtue of section 30 (Investigations and proceedings conducted by public authorities) is exempt information if it's disclosure under the Act would, or would be likely to prejudice;

(a) The prevention or detection of crime

(b) The apprehension or prosecution of defenders

The exemption applies due to sensitivity of some organisations being identified as participating in the delivery of the Prevent programme. Given the sensitivities around Prevent funding and provider status, disclosure would undermine our preparedness to deliver the programme in response to identified threats and vulnerabilities and reduce capacity in the future. Future strategies or operations may be prejudiced if information relating to specific areas of threat and vulnerabilities are inappropriately disclosed into the public domain undermining our ability to respond with potential implications for safety of the general public.

3. Which council department is responsible for allocating PREVENT funding?

The delivery of Prevent is overseen by the Policy and Communications Department, however the Office of Security and Counter Terrorism at the Home Office allocate funding for projects based on a rigorous assessment of its ability and likelihood to deliver against Prevent objectives and the key threats and vulnerabilities. Prior to submission applications for projects are discussed and approved by the Lancashire Contest Board.

4. Is there a PREVENT focus/steering group? Who and what bodies does it consist of?

The expectation is that all local areas will have a partnership tasked to take forward work on Prevent using the most appropriate structure in their area and to a level which is proportionate to local risk.

The Lancashire CONTEST Board provide leadership and direction to the County on counter-terrorism issues, including the development and delivery of the Prevent Delivery Plan.

Membership of the Board will include:

* Local Authorities Chief Executives;

* Divisional Commanders from the Constabulary;

* Lancashire Strategic Cohesion Partnership representatives;

* County Leads for Prepare, Protect and Prevent;

* Counter-terrorism leads from the Police/Probation/NHS/Prisons;

* Representatives from Primary/Secondary and Higher Education Sectors;

* Community Safety representatives Lancashire County Council (LCC);

* Safeguarding leads - LCC and Blackburn with Darwen;

* Faith sector representatives.

5. Please attach any documents/research that the council has undertaken to assist its decision making process of allocation and areas to focus on.

Dear Blackburn with Darwen Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Blackburn with Darwen Borough Council's handling of my FOI request 'PREVENT Programme'.

"Sensitivities" are not covered by the Freedom of Information Act, it is only in relation to "prevention and detection of crime" and "apprehension and prosecution of defenders".

To request (a) the name of the organisations, and (b) the amount of money they have received, has nothing to do with what the Freedom of Information Act allows for exemption. These matters within the statute are to do with policing matters and have no correlation to the listing of organisations who are recipients of PREVENT funding / taxpayers money, how much they are getting, and the purpose of the funding. Neither is information on how the Council reached their decisions.

"Sensitivities" and "public interest" are not the issue here neither are they a pretext to withhold information. Arguably it is in the public interest to know where public money is going, Blackburn with Darwen Council disclosed similar information back in 2009 about PREVENT funding when requested by the TaxPayers Alliance. What "public interest test" did the Council apply then? Did "Section 31(1)(a) and (b)" not apply back in 2009?

The application of Section 31(1)(a) and (b) does not apply to "sensitivities" and neither was my Freedom of Information request asking for "information relating to specific areas of threat and vulnerabilities".

Dear Mr Quraishi,

 

I am contacting you in relation to  your request for information regarding
the PREVENT programme (our reference number 22846). The Council wish to
amend their position regarding point (5) of your request which was as
follows: (5). Please attach any documents/research that the council has
undertaken to assist its decision making process of allocation and areas
to focus on”.

 

Blackburn with Darwen Borough Council used the ‘Counter-Terrorism Local
Profile’ to assist in its decision making process of allocation and areas
to focus on. This is not held by the Council and is held by Lancashire
Constabulary, the Council only had sight of the document at meetings with
the Constabulary and did not retain a copy. In addition the
Counter-Terrorism Local Profile is produced and published by Lancashire
Constabulary therefore it is not ‘documents/research that the council has
undertaken’ and does not fall in to the remit of your request. I can also
confirm there is no further ‘documents/research that the council has
undertaken to assist its decision making process of allocation and areas
to focus on.’

 

Therefore for point (5) of your request, the use of Section 31(1) of the
Freedom of Information Act was incorrect and the correct position is ‘the
information is not held’. Please accept my apologies for any inconvenience
caused.
