Dear University of Salford,

I've been shown some 2018 documents containing details of a working group involving the university, Greater Manchester Police, the Department for Education, the University of Manchester and FE institutions including Manchester College. One aim of the working group seems to be to create a legal means for Prevent data to be shared between FE and HE institutions.

I would like to request the following under the FOI Act.

1. Any material outlining the purpose / brief / framework of this working group
2. A list of the dates, locations and attendees at each of these meetings
3. The minutes for each of these meetings
4. A copy of the final agreed protocol on Prevent information sharing
5. All previous draft versions of this final document including comments on proposed changed
6. A copy of all correspondence related to the development of this document
7. A list of all institutions with whom (4) was shared as a model policy and copies of the relevant correspondence
8. A list of all educational institutions using (4) or some variation of it

Dear University of Salford FOI Team,

Thanks for responding to my request.

However, I must say I was surprised to be told that “after liaising with the university’s Prevent Lead” you had “been advised that there may be reasons to suspect that this request is vexatious.”

My understanding, is that a request for information can only be deemed “vexatious” if there is evidence a request has been made habitually without reasonable grounds, or with an improper purpose such as frustrating the operations of a public authority.

Indeed, in Lee v Information Commissioner and King’s College Cambridge (2012) EA/2012/0015; 0049; 0085, the judge concluded that vexatious under the FOI Act can only mean “manifestly unjustified, inappropriate or improper use of a formal procedure”.

Please can you explain to me a) what evidence there is to suggest my request is vexatious? And b) why you have requested that I supply ID and how this would alleviate the “vexatiousness” of the request?
