to provide you with a response to your request for information also dated
21 October 2011.

 

As you know we have dealt with your request in accordance with your
‘right to know’ under section 1(1) of the Freedom of Information Act
2000 (FOIA), which entitles you to be provided with a copy of any
information ‘held’ by a public authority, unless an appropriate
exemption applies.

 

Request

 

In your request you referred to the fact that representatives of the ICO
make presentations and speeches at events which are not accessible to
members of the public, and asked the following:

 

Please would you:

 

1.    Provide a list of these occasions over the last 24 months

2.    Provide the slides, presenters notes and notes made by the presenter
during the event

 

 

Information Held

 

We have considered each part of your request separately, and would respond
as follows.

 

Request 1 – list of ICO speaking engagements since October 2009

 

Firstly, we should explain that it has not been possible to compile a list
of all speaking engagements carried out by ICO staff in the last 24
months, as we do not hold this information prior to October 2010 (ie we
only details of speaking engagements and events for the last 13 months). 

 

The ICO does maintain a list of external events which representatives at
the ICO are due to attend, within our ‘Corporate Calendar’.  This
information is available to all ICO staff via our Intranet for information
purposes.

 

However, the Corporate Calendar is a current and future looking tool for
use within the ICO, and is not held or retained as an archive or
historical record as it has no operational use to the ICO once the events
listed have passed.  Therefore, currently the only information still
available via the Corporate Calendar which falls within the scope of the
first part of your request are those engagements listed for October and
November 2011.  Details of the speaking engagements listed within the
Corporate Calendar for October and November 2011 are attached by way of a
partial response to this part of your request.

 

We have also attached an additional list of speaking engagements
undertaken by ICO staff between October 2010 and September 2011.  This
list has been compiled from archive e-mail updates which were sent by
staff to our Corporate Affairs Department (who are responsible for keeping
and updating the current Corporate Calendar), notifying them of
forthcoming engagements and events. 

 

Unfortunately we cannot guarantee that this list is totally accurate. 
This is because occasionally speaking engagements or other commitments
have had to be cancelled or rescheduled, and as the list has been compiled
from archive e-mails it has not been possible to check the accuracy of all
the engagements and events listed.  In addition, given that our Corporate
Affairs Department rely on individual members of staff or their assistants
to notify them of any forthcoming engagements to populate the Corporate
Calendar, it is of course possible that Corporate Affairs are not notified
of all engagements that are carried out.

 

We are unable to provide you with any information prior to October 2010 as
this information is no longer held.  There are three reasons for this. 
Firstly, as we have already explained we do not retain copies of the
Corporate Calendar for more than two months (October 2011 being the oldest
record we hold).  Secondly, our Corporate Affairs Department have only
kept those e-mails notifying them of forthcoming events for inclusion on
the Corporate Calendar from October 2010.  Thirdly, whilst it would be
possible to check the individual calendars for all members of staff who
currently undertake external speaking engagements to check the events and
engagements they have listed, the calendar system we use (Microsoft
Outlook) automatically deletes all entries after 13 months, and as such no
information is available within the individual calendars for any members
of staff prior to October 2010.

 

In addition to the copies of the Corporate Calendar which we have provided
for October and November 2011, and the archive list for October 2010 to
September 2011, we would also mention that our website does already
include a list of some of the more high-profile speaking engagements
carried out by the ICO since May 2009, and in some cases the slides and
presentations used by the ICO representative are also available.  The

Request 2 – Copies of slides, notes etc used during each presentation

 

Firstly, we should explain that aside from the information which is
already available on the website via the above link, we do not hold a
central record of the slides, presentations and notes used by ICO staff
when they have taken part in an external speaking engagement.  Therefore,
in order to comply with this part of your request it would be necessary to
contact each relevant member of staff to ask that they conduct their own
manual check of any records they may have kept from such previous
engagements.

 

In the circumstances, unfortunately we are not able to provide you with
the information you have requested in Part 2.  We will explain in more
detail below why this is the case, but in brief, section 12 of the FOIA
makes clear that a public authority (such as the ICO) is not obliged to
comply with an FOIA request if the authority estimates that the cost of
complying with the request would exceed the ‘appropriate limit'.  The
‘appropriate limit’ for the ICO, as determined in the ‘Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004Â’ is £450.  We have determined that £450 would equate to 18 hours
work. 

 

As we have already explained we no longer hold, or can compile, a list of
the speaking engagements carried out prior to October 2010.  Even where
this information is held (as illustrated in the attached lists), in order
to locate, retrieve and extract the information you have asked for it
would be necessary to ask each individual member of staff to carry out a
manual search of their own records for materials used during previous
speaking engagements. 

 

We can confirm that currently 41 members of staff at the ICO undertake
external speaking engagements (we should mention that some of those staff
referred to in the attached lists no longer work at the ICO).  Depending
on the number of speaking engagements carried out over the last 13 months
we estimate that it would take approximately one hour for each member of
staff to manually check the records they hold for each of the engagements
they have carried out, in an effort to locate, retrieve and extract the
information you have asked for in Part 2 of your request.  Therefore, we
have concluded that the time it would take for all relevant members of
staff collectively to carry out all necessary checks of the records they
hold would take longer than 18 hours, which would accrue a charge of
£450. 

 

It is for this reason, and in accordance with section 12 of the FOIA, that
we are not obliged to comply with Part 2 of your request for information.

 

Conclusion

 

Although we have explained why we have not been able to provide you with
all the information you have requested in Parts 1 and 2 of your request,
if you are able to narrow the scope of your request in Part 2 we may be in
a position to provide the information free of charge, if it will cost us
less than the appropriate limit to do so. 

 

For example, if you can narrow the dates you are interested in, or if
having had a look at the information available on our website and the
attached lists you can specify any speaking engagements or events you are
particularly interested in, then we may be able to conduct further
searches and provide the information you seek.  It may help to clarify
that the Departments which undertake external speaking engagements are the
Executive Team, Strategic Liaison, Policy Delivery, Enforcement, Good
Practice, and the Scotland, Wales and Northern Ireland Offices.  Further

We should point out that any reformulated request you may wish to make to
the ICO will be treated as a new FOI request, and the 20 working day time
limit will begin again.

I am writing to request an internal review of Information Commissioner’s Office's handling of my FOI request 'Presentations Made by ICO Staff'.

I am surprised this information cannot be provided. I will address each of your points, however I am especially concerned that it has taken the full 20 working days to respond and that as the body "promoting openness by public bodies" this information is not proactively published by the ICO, either within the requirements of the Freedom of Information Act, or outside the scope for transparency and to enable all public authorities to understand the position of the ICO so they may be compliant with the requirements of the Act. I would ask that this is reconsidered at the corporate level.

Further points I have and which I would like to be considered during the internal review are;

1. It is stated that it is only possible to provide a list of engagements from October 2010 onwards. Is this information not held on backup tapes? I would also believe individual speakers hold this information themselves. Note: Please provide a copy of your retention policy which determines this information is only held for 13 months.

2. I would dispute it would take 41 members of staff an hour each to locate the information. I would believe this to be nearer to 10 minutes maximum if the ICO is compliant with the section 46 code of practice for records management. Surely they store presentations in a presentations folder with the appropriate naming conventions and metadata?

treat calendar entries as records and we do not use Outlook as a corporate
record keeping system. However, we have been able to locate the following
note which was issued to all staff via the ICOÂ’s Intranet on 29 April
2010 (OMC refers to our Operations Management Committee):

‘Outlook calendar update

Just a reminder that, following agreement at OMC, all entries in your
Outlook calendars older that 400 days are going to be automatically
deleted from now on. As well as the obvious benefit of reducing the amount
of space allocated to Outlook, this will improve the organisationÂ’s
information management.

Your request for an internal review of the handling of your information
request (case reference number IRQ0421669) has been passed to me to
undertake. I have considered the scope of your request, the response sent
to you and the specific points you have raised.

 

Your request was considered under Section 1(1) of the Freedom of
Information Act 2000(FOIA) which entitles you to be provided with a copy
of any information ‘held’ by a public authority unless an appropriate
provision in the Act applies to the request or an exemption applies to the
information.

 

You requested:

 

‘I note staff at the ICO make presentations and speeches at paid for
events which are not free access for members of the public. As the public
body promoting openness I would like for the public to have free access to
this material.

 

Please would you:

1.    Provide a list of these occasions over the past 24 months

2.    Provide the slides, presenter notes and notes made by the presenter
during the eventÂ’

 

In response to your request for a list of occasions where ICO made
presentations and speeches at paid for events you were provided with:

 

o Copies of ICOÂ’s internal Corporate Calendar for the months of October
2011 and November 2011 which contained entries relating speaking
engagements

 

o A list of speaking engagements since October 2010 which had been
compiled from emails sent from staff to our Corporate Affairs
Department requesting that attendance at events be added to the
Corporate Calendar. 

 

The investigation I have carried out as part of this internal review
confirms that ICO does not maintain a complete list of speaking
engagements and neither does it record whether a speaking engagement is at
an event where there is free access for members of the public or not. The
recorded information you were provided with, compiled from 2 sources
(listed above) included all speaking engagements derived from those
sources but did not attempt to distinguish between paid for and free
access events.

 

I have confirmed that not all speaking engagements are added to the
Corporate Calendar and that details of some speaking engagements which
took place since October 2010 are recorded within the Outlook calendars of
individual members of staff. Calendar entries older than 400 days are
automatically deleted.   

 

As a result I have concluded that our response to this part of your
request did not provide you with all of the recorded information which
fell within the scope of your request. However, it did include some
additional information which did not fall within the scope of your
request namely some free access events. I have asked that a revised list
be prepared. 

 

In response to the second part of your request for slides, presenter notes
and notes made by the presenter you were informed that section 12 of FOIA
applies in that the estimated cost of complying with the request would
exceed the ‘appropriate limit’.

 

As a result of making further enquiries with the large number of staff
involved I have concluded that section 12 does not apply in this case. I
have asked that the recorded information be located, extracted and
considered for disclosure. This process is underway and our response will
be communicated to you no later than 18 January 2012.

 

I have noted your comments about the fact that this information is not
currently being published proactively. I can confirm that this is being
reviewed and that it will also be considered as part of our current
Publication Scheme consultation.

    

If you are dissatisfied with this outcome, you have the right to make a
complaint in writing to the Information Commissioner under section 50 of
the FOI Act.  In that event, your complaint would be investigated
independently by ICO staff who have not been involved so far in
considering your request.

In response to 1) above I have attached a revised list of events
where a presentation or speech was made by ICO over the past 24
months. As I explained in my email of 6 January 2012 we do not
record whether a speaking engagement is at an event where there is
free access for members of the public or not. As a result it is
possible that some of the events listed were free access events.

In response to 2) above I have attached a copy of all the slides,
presenter notes and notes made by the presenter during the event,
for those events which appear on the list referred to above and
where these are held as recorded information.

You will see that there is a very small amount of redacted
information. Section 40(2) of the Freedom of Information Act 2000
(FOIA) allows a public authority to withhold information from a
response to a request under the FOIA when the information requested
is personal data relating to someone other than the requestor and
its disclosure would contravene one of the data protection
principles.

I consider that it would not be within the expectation of the
individuals whose personal data appears on one slide, that personal
data relating to them be disclosed to the world at large, outside
of the context of a particular event, and therefore it would be
unfair and in breach of the first data protection principle which
states that – ‘personal data shall be processed fairly and
lawfully.’

However I hope that the information we have provided is of
assistance to you. I should inform you that if you are unhappy with
the outcome of this internal review then you do have a right to
appeal to ICO in our capacity as the statutory regulator for the
FOIA.

the ICO’s disclosure to you of ICO presentations. In this email you

I would again firstly repeat our invitation to you for us to send you a
hard copy in paper format or on a DVD of the requested information, if you
are willing to provide us with a postal address to respond to. This may be
more legible to you. Secondly, we could potentially place the response
onto the ICO’s disclosure log, if this would be satisfactory? This may
potentially mean that the information is more legible (although this
cannot be guaranteed). Please let us know if you would be happy to accept
one of these options, and if so, provide us with the necessary details to
provide you with the information.
 
If you are solely dissatisfied with the notes sections of the
presentations, I would be grateful if you could confirm whether you mean
notes which have been handwritten, or whether you mean electronically
created notes which are not visible to you?
 
Finally, with regard to the points you raised relating to the proactive
disclosure of this kind of information, I would refer you to and
re-iterate the point made by Ms Bett, in her internal review response.
In this, she stated that the ICO is considering the proactive disclosure
of such information and it will also be considered in the consultation
process regarding our new Publication Scheme.

 I write with reference to your emails of 18 February and 2 March
concerning the additional information provided to you as a result of your
internal review.
 
I have revisited your comments and the suggestions made by my colleague in
his response on 24 February and I feel there may have been some
misunderstanding.  It is my understanding that there are in fact two
issues.  The first being the recorded information provided to you which
related to handwritten notes.  Whilst I understand your concerns regarding
these notes we have provided you with the recorded information and
furthermore have offered to provide these to you again but in different
formats.
 
The second issue is the notes sections within Powerpoint which allows the
author or speaker to type notes.  Where the presentations provided to you
contained additional recorded information in this section, this was
provided to you by printing it in the notes format.  If there were no
notes in that section it was printed in the usual format.  Therefore, you
have been provided with all the recorded information from those sections.
 
I hope this clarifies the situation and please accept my apologies for any
confusion.  As you are aware your new request is being processed
separately and you will receive a response no later than 25 April.
