Can you please provide the following details from the records which you hold under The Licensing Act 2003:-

A full list of all premises who have the sale of alcohol by retail on their premises. The list needs to contain the following:

• Premises Licence Number
• Date Issued
• Premises Name
• Premises Address
• Premises Postcode
• Premises Telephone Number
• Premises Category
• Premises Licence Holder Name
• Premises Licence Holder Address
• Premises Licence Holder Postcode
• Designated Premises Supervisor Name

Requested format:

Please provide the information in a Spreadsheet format, preferably Microsoft Excel (*.xls). If you cannot supply the information in this format please can you explain why?

Thank you for your email of 22 January 2017 requesting information
relating to “a full list of all premises who have the sale of alcohol by
retail on their premises” to include the following:-

 

1.                   Premises Licence Number

2.                   Date Issued

5.                   Premises Postcode

6.                   Premises Telephone Number

7.                   Premises Category

8.                   Premises Licence Holder Name

9.                   Premises Licence Holder Address

10.               Premises Licence Holder Postcode

11.               Designated Premises Supervisor Name

 

Pursuant to Section 17 of the Freedom of Information Act 2000, the Council
must advise an applicant whether any particular exemptions apply to the
provision of the information sought and the reasons for this.

 

The Council does hold information in respect of numbers 1,2,3,4,5,7,8,9,10
and 11 above. I have attached a spreadsheet which provides you with the
information pursuant to numbers 1,3,4,5,7,8,9,10 and 11 above.

 

In respect of numbers 2 and 6 above, requiring the date each licence was
issued and the premises telephone number, this would require us to
interrogate each individual licence / record.

 

Whilst we are mindful of our duty to provide advice and assistance to
those making requests for information, we do not consider it is our duty
to create information for the purpose of responding to requests.  In order
to produce the information that you have requested we would need to
“retrieve or extract” it in some way from our systems.  We estimate that
to do so would take us well in excess of the statutory cost limit in the
Freedom of Information Act 2000 of £450 (which is calculated as being
approximately 2.5 days of a council officer’s time to determine whether
the Council holds the information, locate, retrieve and extract the
information) if the Council supplied the requested information to you.  
Consequently, the Council is not obliged under section 12 (1) of the
Freedom of Information Act 2000 to respond to your request. 

 

If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to Gillian Marshall, Solicitor to the Council.

 

If you are not content with the outcome of your complaint, you may apply
directly to the Information Commissioner for a decision.  Generally, the
Information Commissioner cannot make a decision unless you have exhausted
the complaints procedure provided by Selby District Council.  The
Information Commissioner can be contacted at: The Information
Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9
5AF.
