Pre-planning advice given to applicant of NP/CEC/0323/0337, validated 27/03/23

A. Sheridan made this Freedom of Information request to Peak District National Park Authority Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

The request was successful.

Dear Peak District National Park Authority,

I respectfully request full details be passed to me under the provisions of The Environmental Information Regulations 2004 and The Freedom of Information Act 2000, in respect of pre-planning advice sought from your Authority, by the applicant of planning permission numbered NP/CEC/0323/0337, validated 27/03/23.

The submitted documents show that requests for pre-planning advice have been made and advice given.

The information regarding details of this application is in the public domain. I feel that this information does not hold commercially sensitive viable information for me or any other persons, the application being fully submitted for planning panel adjudication. It appears not to hold sensitive, confidential or personal data under the relevant acts.

I request details as follows:

1. Under the Environmental Information Regulations and Freedom of Information Act, please disclose all Peak District National Park Authority pre-planning information/advice given to the applicants for “Relocation of car park, restoration of swine ground, visitor access improvements and new hall and garden entrance.” Ref NP/CEC/0323/0337 including emails, but also details of phone calls, notes, letters etc.

Please note that, across a number of appeals, Decision Notices by the Information Commissioner's Office consistently support disclosure of pre-planning advice once the formal planning application has been made (as is the case here).

Please note that the LGA Probity in Planning guidance states:

"Confirmation that a written note should be made of all meetings. An officer should
make the arrangements for such meetings, attend and write notes. A note should also
be taken of any phone conversations, and relevant emails recorded for the file.
Notes should record issues raised and advice given. The note(s) should be placed
on the file as a public record."

I understand that the legislation allows 20 working days for a detailed response from yourselves, however due to the fact that the public consultation ends relatively soon on 19th May 2022, an early reply is requested .

Yours faithfully,

A. Sheridan
