Regarding the above planning application, could you please provide:

· Details of any pre-application advice and any general advice that was given by, or under the auspices of, the Isle of Wight Council and the Local Planning Authority to the applicant and/or their agent/s, regarding this application.

· Any details/advice given to the applicant (UK Oil and Gas PLC) and/or their agent/s regarding any precursor application, within the five years prior to this application, regarding exploration and appraisal of hydrocarbon minerals on the Isle of Wight.

In the event of your not being able to accede to any individual request above, in whole or in part, please treat each separate item, in part, as a separate request independent of the others and respond appropriately to each.

Dear Mr Hirst

 

Thank you for your information request dated 22^nd June 2020, and received
by the Isle of Wight Council on the same day, which is currently being
considered.

 

As required by the Freedom of Information Act 2000, the Isle of Wight
Council will respond to you as soon as possible and no later than 20
working days after the receipt of your request.

 

Under the Act, there is a limit for responding to requests where they
exceed the Appropriate Fee Limit as set out in the Freedom of Information
and Data Protection (Appropriate Limit and Fees) Regulation 2004. The fee
limit is set down by the Lord Chancellor and is £450 which equates to a
maximum of 18 hours of search and retrieval time.

 

Should your request fall into this category, we will notify you as soon as
possible, to discuss any options available to you.

 

If you have any complaints in respect of your information request, please
write to the Corporate Information Unit at County Hall, High Street,

submission however, pre-application discussions are confidential.

hydrocarbon minerals on the Isle of Wight.

May I clarify the exact ground under which you are refusing to provide the information as requested.

To reiterate, regarding the planning application, 20/00513/FUL, please provide:

- details of any pre-application advice and any general advice that was given by, or under the auspices of, the Isle of Wight Council and the Local Planning Authority to the applicant and/or their agent/s, regarding development and exploitation of minerals or otherwise in the declared boundaried areas proposed for development under the application.

This request includes but is not limited to:

- a copy of any PRE-PLANNING APPLICATION ADVICE - RESPONSE FROM PLANNING made relating to the application or pre-cursor applications;
- copies of any other responses, in particular responses that relate to:
- the management, control and removal of waste, whether on-site, its transport to a disposal site within the Isle of Wight geographical area, its transport to a port of embarkation from the island to an onward disposal site;
- risk of pollution, mitigation of such risks, and plans for managing environmental contamination arising from the proposed activities;
- the matter raised in answer to question 1.3 of the THE TOWN AND COUNTRY PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) REGULATIONS 2017 SCREENING MATRIX document relating to the comment "At this stage, the Planning Authority concludes a Significant Effect based on this uncertainty" (uncertainty relating to a Hydrogeological Risk Assessment).
