Our Response:

 

This request is being treated as a request for environmental information
request under the Environmental Information Regulations 2004 (EIRs).

 

Please see the attached documents.

 

You will note that certain information within the attached documents has
been redacted (removed). This is because it relates to the identities and
signatures of individuals involved in this process and the Council
considers that this information meets the definition for personal data set
out in the Data Protection Act (DPA).

 

Regulation 13(1) provides an absolute exemption (i.e. the public interest
test does not apply) for information about identifiable individuals where
this would breach the Data Protection Act. Personal data of third parties
can only be disclosed in accordance with the data protection principles;
particularly, the first data protection principle requires that personal
data should be processed lawfully, fairly and in a transparent manner.

 

In coming to the decision to withhold the information, consideration has
been given to the Data Protection Act principles that: the processing of
personal information should be lawful and fair. In addition, such
processing should be transparent in relation to the rights of the data
subject. Furthermore, such information should be processed in accordance
with the rights of the data subject who would have a legitimate
expectation that the information would not be disclosed to members of the
public.

 

In accordance with the Environmental Information Regulations, this
response acts as a partial refusal of your request.
