Health Service Ombudsman.

 

I start by sincerely apologising for the time it has taken to provide you
with a response to your information request. We had aimed to provide a
response by the 26 January 2018 and acknowledge that our response has been
delayed. I would like to thank you for your patience during our processing
of you information request. 

 

I can confirm that we hold the information you requested in your email of
19 November 2017 on electronically.

 

During the period of October 2015 to December 2017 we received 27
pre-action letters.

 

The number received per year is:

 

·         2015 - 3 (from October)

·         2016 – 20

·         2017 – 4 (up to and including December)

 

Please find attached a breakdown of the pre-cation letters received
October 2015 to December 2017.

 

I hope you have found this email helpful. If you believe I have made an
error in the way I have processed your information request, it is open to
you to request an internal review.  You can do this by sending an email to
[1][Parliamentary and Health Service Ombudsman request email]  you will need to specify what the
nature of the issue is and we can consider the matter further. Beyond

You're request has revealed some interesting information.

Why was there five times fewer pre-action letters in 2017 compared to 2016?
The main reason has to be that the CCT were timing most people out of the possibility to apply for judicial review. There is no point in sending a pre-action letter after the 3 month window for application for judicial review has closed because the CCT were taking at least 16 weeks to even consider a review.
