Practice directions 12 : Health = Physical and Mental health

In the House of Commons yesterday 3/10/19 : Women’s Mental health Motion The health and Social care minister Nadine Dorries shared her ‘personal story’ of her own experiences of mental health.

Nadine Dorries shared her personal experiences of mental health to help break down ‘stigma’ that surrounds mental health. She made the analogy showing a person who breaks their leg can be seen as having poor physical health because one can see the plaster cast. Mental health she stated needs to be seen in the same way: for the ‘illness’ that it is.

1. Please provide the information CAFCASS hold where they contradict practice rule 12 and contradict WHO, MP’s and specialist experts where CAFCASS knuckle grinding draconian framework obtained outdated misleading information that ‘mental health’ is harmful parenting ?

2. What information does the incumbent CEO hold to bring CAFCASS framework of Bigotry and discrimination against persons with mental health diagnosis up to date with current legislation, practice rules and Heath definitions/guidelines ?

3. HOW does CAFCASS CEO plan to identify families/children affected by CAFCASS bigotry and lack of understanding of mental health legislation where CAFCASS stereotyping has adversely affected families ?

I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'Practice directions 12 : Health = Physical and Mental health'.

I believe you have applied S14 incorrectly. This is because CAFCASS framework is inconsistent with Equality and at variance with PDR 12 and Equality guidelines available to the Judiciary : Equal Treatment Bench Boom [February 2018]. This has the adverse impact upon families and children therefore please provide the information requested even if it does highlight CAFCASS’s framework at odds with guidance provided to the Judiciary.

Dear Governance,

Cafcass is not operating a process ‘parallel to FPR’ and bench guidelines therefore provide the information you hold to demonstrate why CAFCASS is at a variance re: mental heath/health & diagnosis where health = Health in FPR, WHO guidelines yet CAFCASS operating in distinctively different operating procedures out of line with legislation and guidelines.

Dear Governance,

May I point out a cumulative pattern is emerging here. When CAFCASS use FOIA to incorrectly apply S14 where I raise serious concerns about CAFCASS , governance have previously applied vexatious but when challenged after I have pursued the issues; because CAFCASS I has used FOIA incorrectly either :

Mr Gibbs has apologised
CAFCASS have included disability

Thus applying S14 has, historically been inaccurate therefore CAFCASS should take heed of this and desist from using S14 as a panic button to obstruct information.
It is unfortunate CAFCASS find my requests burdensome however, rolling out a highly flawed unscrutinised framework which is a virus in a vial towards people with protected characteristics would mean any reasonable person would, in good faith as I have request information where CAFCASS are operating recklessly and harmfully.

decision made in the FOI response of CAF 19-165  and requested a review of
the decision.

A Senior Officer who was not party to the original decision on whether to
release the information will conduct the internal review. An internal
review involves a review of the decision on disclosure in the original
response and the way in which the request was handled. The internal
reviewer can either uphold or overturn the original decision.

 

Cafcass will notify you as to the final decision made regarding your
internal review 20 working days from receipt of your request.  You will
therefore receive a response on or before 25 November 2019.

Dear Governance,

You have applied S14 incorrectly. Head of Legal applies S14 to deem the requester vexatious as a mechanism to enable CAFCASS staff to freely discriminate and engage in unlawful acts. It is in fact CAFCASS and CAFCASS Legal who are not only pursuing an agenda to cover up their own unreasonable and persistent unlawful acts but to enable them to continuously undertake unlawful acts and acts that may be offences. Ms Carew misuses the DPA to pursue an internal agenda unlawfully.
