Dear Maidstone Borough Council,

I am requesting a copy of the Planning Performance Agreement (PPA) between yourselves and the proposer(s) for the "garden settlement" proposal at LAND NORTH OF MARDEN, MAIDSTONE ROAD, KENT which has been entered into earlier this year.

In addition, I am also requesting any copies of correspondence & minutes between MBC and the proposers in regards to this Planning Performance Agreement (PPA) between 1st January 2018 and now.

I would point out that I am making this request under the EIR as it involves land development and believe that the presumption in favour of disclosure would apply. I would also point out politely that government's "Planning Guidance" notes para. 023 state that "The parties are encouraged to make the existence and content of a planning performance agreement publicly available, so that the agreed process and timescale are transparent."

FREEDOM OF INFORMATION ACT REQUEST

 

You wrote to us requesting information on a Planning Performance Agreement
(PPA) between the Council and the proposer(s) for the "garden settlement"
proposal at Land North of Marden.

 

I am writing to advise you that following a search of our paper and
electronic records, I have established that the information you requested
is not held by this Council. This is because the Council has not entered
into a PPA with regard to a proposed garden settlement on Land North of
Marden. As such, there is no copy of a PPA or associated correspondence to
provide.
