Col Philip Cook, Deputy Head of Uk Training for the MOD held a press briefing at which he gave a Power Point presentation to the Guildford Dragon regarding the decision to close part of Ash Ranges Training area to the public. This press briefing was subsequently reported by Guildford Dragon on 25th August. Please provide this presentation together with any associated readers notes.

Thank you for your response and provision of Power Point Presentation which appeared as Annex A.
I would draw your attention to slide 23 of that presentation. That slide contains an image, centrally placed over the original images from the preceding slide and depicts 2 dogs looking out over the range.
I must advise that you do not hold the image rights for this picture or authority for it to be published, especially in the context used whereby there is deliberate intent to link that picture to those (within same slide) depicting criminal damage.
Accordingly this infringement has now been reported to the CEO of the DIO to ascertain how and why this image was obtained and used.

Thank you for your response and it is noted that you admit unauthorised use of the image in question, it is also noted that you have so far failed to provide how this image came into your possession or why it was used in publication.
Your proposal that I should merely delete the Annex A originally supplied is a purely perfunctory response given that you have previously used the original Annex A in presentations to the news media, Ash Parish Council and possibly more before adding it to the public accessible What do they know website.
The use of the image was a cynical but ill judged attempt to link the criminal damage elements on that slide to the animals and/or their owner or handler.
Accordingly I shall await your response and that of the CEO of the DIO to whom I wrote my letter of complaint.
The use of this image and it’s inference of criminal damage directed toward the animals and their owner/handler cannot be underestimated.
I shall await the responses while contemplating the appropriate next course of action.

I am writing to request an internal review of Ministry of Defence's handling of my FOI request 'Power Point Presentation made by Col Philip Cook'.

Following receipt of the requested Power Point Presentation it was noted that an image of 2 dogs had been overlaid on other images purporting to show criminal damage, the intent was clearly to link the animals or their owner/handler to the criminal damage shown.
The DIO/MOD did not have ownership of the image used or any authority to use it, especially in the way that it was used.
Following my response back to the DIO on this matter I received a revised Annex A with the image removed and confirmation that 3rd party information that was not authorised for release had been used.
This is totally unacceptable as the presentation had already been used in its original format at Press Briefings and meetings with the local council as well as placement on the public accessible What Do They Know site.
My request has still remained unanswered, namely how did the DIO/MOD obtain the image used, why was it used in such a manner that the image content was intentionally linked to the depicted criminal damage and who provided authority for it to be used?

Dear Mr Corns,

Thank you for your email of 27 January, in which you have asked for an internal review to be conducted into your request titled ‘Power Point Presentation made by Col Philip Cook’ which sought release of the ‘presentation together with any associated readers notes’.

Your request was submitted on 6 November 2020 and was logged under FOI2020/12266. DIO provided a response dated 7 December 2020, which attached a copy of the requested presentation. Some information was withheld under section 40(2) of the FOI Act. As this request was submitted and processed under the FOI Act, an internal review can be conducted on the application of section 40(2), if required. Please confirm and we will proceed with the internal review.

Your email of 11 December 2020 states that you reported a copyright infringement to the CEO of DIO ‘to ascertain how and why this image was obtained and used’. We can advise that any personal correspondence that you have sent to the CEO of DIO will be handled separately and outside of the FOI Act. I should advise that if your correspondence was sent in the post, it may not have been received yet due to the COVID-19 pandemic restrictions, with limited access to MOD buildings.

In your email of 27 January, you ask for a review of your request which you describe as seeking answers to questions about ‘how did the DIO/MOD obtain the image used, why was it used in such a manner that the image content was intentionally linked to the depicted criminal damage and who provided authority for it to be used’. However, these questions were not part of the original FOI request you submitted, but appear to relate to your copyright infringement complaint. I should advise that the remit of this team only extends to the consideration and review of the way in which FOI requests have been handled. We have no authority to review or investigate matters arising from complaints that have been submitted to the Department outside of the Act.

If you had intended for these further questions to be handled under the FOI Act, please let us know and they will be logged as a new request.

Please note that in your previous reply dated 5th February you stated that your remit only extends to the way in which FOI requests have been handled and that my question regarding copyright was not part of the original request, additionally you said that any correspondence sent to the CEO of DIO will be handled separately and outside of the FOI Act.
The CEO of the DIO has received my full postal address in both letters sent to him which have been declared as delivered by Royal Mail delivery record.
Please also note that I advised you on 2nd February that I had sent an email to the DIOSec-parli@mod email address quoting this FOI number, providing my personal email address and the reason for supplying it, subsequently I received an email response of confirmation.
