Common Law Jurisdiction

Dear Craven District Council,

I want you to think very carefully before giving a vague or evasive answer on this as it may come back to bite you.

1. Do your staff, specifically those in the taxation department understand the laws surrounding power of attorney?

2. Do they ever advise people that they can take control of someone's account, declarations, address history by simply writing a letter in without knowing if they hold power of attorney and without the consent of the person it is about? Specifically are there any recorded instances of this and is this advice that is council approved?

Please think very carefully about your answer here. Like I said to give you fair warning this could come back on you if it isn't answered properly.

Yours faithfully,
Bart Joseph

Dear Craven District Council,

You can ignore this FOI now. I have spoken to a lady who knows the power of attorney, data protection etc and informed me that you apply it. Obviously someone has given out wrong information, but I will treat that as an innocent mistake. I trust the rest of the council tax team will be reminded of the law.

Yours faithfully,
Bart
