Pothole Damage Claims

The request was partially successful.

Dear Portsmouth City Council,

Please could you provide the process in which motorists should use to make a claim against the council for pothole damage to vehicles.

It would be appreciated if you could include the name of the department responsible for handling claims, telephone number, email address and postal address.

Is there a timeframe in which the claim must be made after the incident and repairs are completed?

Also is there any other information required apart from date/time location, photos of locus, vehicle damage and repairs invoice in order to make claim?

Yours faithfully,

Martin Cutler

Dear Mr Cutler

INFORMATION REQUEST – FOI2018/0265 - Pothole Damage Claims

Thank you for your request for information received on 26^th February
2018, which was considered under the Freedom of Information Act 2000.

In accordance with the Act, Portsmouth City Council confirms it does not
hold the information.

YOUR REQUEST:

Please could you provide the process in which motorists should use to make
a claim against the council for pothole damage to vehicles.

It would be appreciated if you could include the name of the department
responsible for handling claims, telephone number, email address and

Also is there any other information required apart from date/time
location, photos of locus, vehicle damage and repairs invoice in order to
make claim?

OUR RESPONSE:

In 2004, Portsmouth City Council entered into a private finance initiative
contract with Ensign Highways (delivered by Colas Ltd) which, in return
for a fixed annual fee of approximately £23m, ensures the rehabilitation
and maintenance of the highway infrastructure of Portsmouth.

The contract sets out very specific levels of service that must be kept to
at all times and rigorous specifications for the day-to-day maintenance of
the highways.

This means, for example, that response times to repair defects are now
dramatically shorter than they were before the contract started and that
the council is able to budget more effectively.

We can confirm that Portsmouth City Council does not hold the information
you request as all compensation claims are managed solely by Colas/Ensign
under the contract. For more information about the PFI contract, please

our treatment of your request.  If you wish to do so, please set out in
writing your grounds of complaint and send to the Corporate Information
Governance Officer at Portsmouth City Council, Civic Offices, Guildhall
Square, Portsmouth, Hampshire, PO1 2AL, telephone 023 9268 8482, e-mail

Should you be dissatisfied with the outcome of the complaints decision you
may wish to follow the Portsmouth City Council’s Compliments and
Complaints procedure which can be found on the Portsmouth City Council
website or by contacting the Civic Offices.

Once these processes have been exhausted you have a further right of
