Dear Sirs,

A list of public bodies and local authorities that are subject to the provisions of the Freedom of Information Act is included in Schedule 1 to the Freedom of Information Act 2000.

As you will see, the Freedom of Information Act 2000 does not list any person appointed under the Representation of the People Act 1983. It follows that the Electoral Registration Officer, Returning Officer or any other person appointed under the Act are not subject to the provisions of the Freedom of Information Act. Therefore, the Returning Officer is not obliged to answer your request for information.

Dear Aftab Razzaq,

Noted; however, Schedule 1 part II clause 7(a) refers to the Local Gov Act. The Local Gov Act refers to the Representation of the People Act multiple times; therefore, without the former the latter would be irrelevant and by association should be included. In addition, as you point out, the FOI act does not exclude the RPA or those governed by it. The FOI act does not list all departments of the local authority, yet they are considered to be included.

Within "RBC FOI Publication Scheme v2.2/2010" elections are mentioned multiple times and in Section 1.3 Governance the Role of the Returning Officer is identified. There is no indication of an exemption; so, by omission the information requested should be available.
