Dear Access 2 Info (Commissioning Communities and Policy),
Please Refer to https://www.whatdotheyknow.com/request/e...
in the Government's response to the Political and Constitutional Reform
Select Committee's report 'Voter engagement in the UK', it was stated:
"The Government agrees that there is a case for bringing EROs [Electoral
Registration Officers] and ROs [Returning Officers] under the FOIA
[Freedom of Information Act 2000]. There is insufficient time remaining in
this Parliament to complete the required steps (including formal
consultation with EROs and ROs), so this will necessarily be an issue for
the next Government. It is worth noting that the Association of Electoral
Administrators advises its members to behave as if they were already
subject to the FOIA, and the Government understands that many, but not
all, do so."

and IN PARTICULAR the Electoral Commissions guidelines to Electoral Officers that they should provide data if either it is in the public domain OR does not contain personal information
Our published guidance for Electoral Registration Officers (EROs) and for
Returning Officers (ROs) makes clear that while EROs and ROs are not a
public authority under the Freedom of Information Act 2000 and, as such,
are exempt from the disclosure requirements imposed by it, they should,
wherever possible disclose the requested information, provided this
information is already in the public domain, or the information requested
does not include personal data. Our guidance for EROs is available on our
website at
[1]http://www.electoralcommission.org.uk/i-...
and the relevant content is contained in Part 4 from paragraph 12.57. Our
guidance for ROs at the May 2015 UK Parliamentary general election can be
found at

and the relevant content can be found in Chapter 5 of Part F.
