Dear Department for Business, Energy and Industrial Strategy,
The following quote appeared on the BBC today concerning Government behaviour toward Grensill. "They added it was "perfectly normal - and right - that government gathers all relevant information when approached for taxpayer funds to support a business".Can you say what information you gathered from POL before allowing them to enter the doomed Horizon Court Case and waste hundreds of millions of tax-payers money. For instance proof of Horizon robustness, likelihood hundreds of SPM had gone rogue, chances of winning etc?

Yours faithfully,

john o'sullivan

Dear FOI Requests,
I first contacted you on 7 july asking what info the sole-shareholder who has oversight and challenges POL knew of Horizon and POL prosecutions.Surely releasing that information has not become a political decision?Over time POL has dealt with at least a dozen Ministers all of whom seemed powerless to stop the abuse of process.Understanig what each new Minister was briefed on taking over will help POL and Government reach thier stated aim of making sure lessons have been learned and it cant happen again.Unless you know different?

Dear FOI Requests,
Thank you for a reply but could you clear up two concerns.Firstly although the brief given to Jo Swinson is not signed it will have had an author. You cant advise a Minister that two Organisations hold a definate position on a matter without supplying proof to support this assertion(if the Minister asked for same). Can you look again for why BEIS felt it could tell the Minister CWU/NFSP were confident in Horizon as they have both denied saying this?Secondly when you compare the detail supplied in Jo Swinson brief(it appears to be the entire document)with those to other Ministers they seem embarassingly short of detail. Can you look at supplying the entire briefs rather than bullet points,

Yours sincerely,

john o'sullivan

FOI Requests, Department for Business, Energy and Industrial Strategy

Dear Mr O'Sullivan,

Thank you for your email.

The first question in your most recent correspondence is as follows: "Can you look again for why BEIS felt it could tell the Minister CWU/NFSP were confident in Horizon as they have both denied saying this?" Content-wise, we have understood this question as seeking the same information as your previous FoI request dated 10 November 2021, where you asked: "Which document enabled Government to tell Jo Swinson that 'both the NFSP and CWU have expressed full confidence in the system'?"

We responded to your request on 18 March 2022, stating that we would not be able to answer your request without exceeding the cost limit of £600 provided under Section 12 of the Act. As your most recent question is seeking the same information, the same response applies. However, as previously explained, if you were to refine your request to a specific document or specific time period, we will give due consideration to our obligations under the Act in respect of that request.

The second question in your most recent correspondence regarding the day 1 briefings for new postal ministers is as follows: "Can you look at supplying the entire briefs rather than bullet points." Your original request dated 10 November 2021 was for the "notes on Horizon provided to new ministers between the years 2000 to present." On 18 March 2022, we supplied all the relevant Horizon-related extracts from the briefings, as this was the only information from the briefings that was in scope to your request.

The other information on the documents which was not provided to you was all irrelevant to your request and was therefore redacted. For this reason, we decided it would be easier for you to receive all the information that was in scope to your request in one place rather than multiple pages of redacted information. If you wish to make a further request which calls into scope other parts of the day 1 briefings, we will again give due consideration to our obligations under the Act in respect of that request.

Dear FOI Requests,
Thank you for a very prompt reply. Can I ask what information led you to tell Jo Swinson "both the NFSP and CWU have expressed full confidence in the system" rather than what document led you to be able to state this as a fact. Can I ask to see day 1 briefings for all ministers with responsibility for Postal Affairs.I fail to see how Jo Swinsons brief was provided in full but you believe other briefs to other Ministers need redacting

FOI Requests, Department for Business, Energy and Industrial Strategy

Dear Mr O'Sullivan,

Thank you for your request for information of 30 March below.

We can confirm that the Department holds information within the terms of your request, however we need more time to consider.

The Freedom of Information Act ('the Act') obliges us to respond to requests promptly and in any case not later than 20 working days after receiving your request. However, when a qualified exemption applies to the information and an accompanying public interest test is engaged, section 10(3) of the Act allows the time for the response to be extended, in which case a full response must be provided within such time as is reasonable in all circumstances. The exemption which applies to the information that you have requested is s43 (Commercial Interests).

The Department has not yet reached a decision on the balance of the public interest. Due to the need to consider, in all the circumstances of the case, where the balance of the public interest lies in relation to the information that you have requested, the Department will not be able to respond to your request in full within 20 working days.

We hope to let you have a response by 30 May 2022.

Yours Sincerely,

Dear FOI Requests,
Thank you for a reply. Can we say who was the author of the brief Jo Swinson got in Sept 2012?That shouldnt take a year and cost £600. The likely purpose and value of releasing information about Minister's Briefings concerning Postal Matters is to ensure 800 SPM's are never again prosecuted, jailed, bankrupted and driven to suicide by unaccountable arms of Government acting without scrutiny or accountability. You are looking at liablity of 100s of millions, six hundred quid budget for truth?Come on you are better than this surely?

Dear FOI Requests,Thank you for a reply. It would appear at least two people drew up the document. Can you say how long these people had been in their roles in Government and how long overall they had worked for Government. What % of civil servants have been with you more than 5,10,15 and 20 years? These people would have a much better grasp of what is happening than a Minister on their first day who relies on a briefing document. That is why the fact that both the CWU and the NFSP disagree with what Jo Swinson was told make it essential we know who told her and on whose instructions.(Why mention it at all-especially as it was untrue?)The SPM familly is very grateful for Paul Scully's endeavours but it would seem not all at BEIS share a desire for truth and openess. So yes, years people were in their job and average career stay in the Civil Service, thanks

Dear FOI Requests,,Thank you for your reply to the above FOI request which you have turned down for many reasons including the purpose and value of the request .That I would have thought was obvious and above price-making sure hundreds of innocent people cannot be imprisoned, made criminals, bankrupted, driven to suicide and made redundant. The largest miscarriage of justice happened under your watch. You supplied wrong information to a series of Government Ministers who in their first day in office trusted and relied on the briefs presented. You are committed to openness in Sir Wyn Williams Inquiry,do you not think he will ask these questions?Perhaps some extra budget can be found, the bill to yourselves for allowing POL to run amok is astronomical and only growing larger each day.I request an internal review fot this FOI but why not do the right thing and just answer these very important questions..John O'Sullivan

Dear FOI Requests,Thank you for a reply.Like most people I have no knowledge of how Briefings to Minister work or what safeguards or checks are available to prevent Ministers receiving false information. The NFSP and CWU dispute that they expressed full confidence in Horizon and yet Jo was told other wise. Can you explain the process for a Ministerial Brief, let us suppose it is wriiten by a Junior Civil Servant-is it then looked at by a Senior colleague before being presented.?Or is it sent off sight unseen by the juniors? If checked by someone higher placed within the Service would they not be responsible for the document and thanks to their senior position be liable for being named? You are in the midst of handing over hundreds of millions of tax payers moiney to compensate victims of a failure to hold POL to account and provide meaningfull scrutiny..Do not these unique and distressing cicumstances put you in mind to break wth tradition and do the right thing?

Yours sincerely,
