Dear Post Office Limited,

Several times in the past you have supplied me with a list of Post Office branches and their opening hours, in response to an FOIA and RoPSIR request that I made. I would now like to ask for an updated version of this data-set and permission to re-use it under the terms of the Open Government Licence v3. The purposes of the re-use are (a) to help improve the representation of Post Offices in OpenStreetMap and (b) to make the data available to others under an open licence.

The data you previously released can be found at https://osm.mathmos.net/postoffice/data/ . As far as possible I would like the updated data in the same format. Specifically this is a CSV file containing one row per opening hours entry (so each branch occupies several lines), with the following fields: LOCATION_OU_CODE, BRANCH TYPE, LOCATION_NAME, TRADING_SUB_STATUS_NAME, LOCATION_ADDRESS_LINE_1, LOCATION_ADDRESS_LINE_2, LOCATION_ADDRESS_LINE_3, LOCATION_ADDRESS_LINE_4, LOCATION_ADDRESS_LINE_5, LOCATION_POSTCODE, BRANCH_LONGITUDE, BRANCH_LATITUDE, WEEKDAY_NAME, AM_TIME_FROM, AM_TIME_TO, PM_TIME_FROM, PM_TIME_TO. I believe that both "open" and "temporarily closed" branches were included in the dataset.

They've asked to us tell people this "may not be entirely up-to-date", well, it's guaranteed not to be now it's Non-Commercial Government Licence v2 and not Open Government Licence v3 like previous releases.

This has actually really annoyed me. We could have ensured OSM was always up to date, but now it never will be.

Many thanks for providing the information I requested. I am not sure exactly what information you did not supply, but it doesn't seem to be important to me, so I am not requesting any review of that aspect.

I would, however, like you to review the licence your specified for the re-use of the information. I asked to be allowed to re-use the information under the Open Government Licence, but you only permitted use under the Non-Commercial Open Government Licence. Unfortunately, this latter licence precludes one of my intended uses to help update OpenStreetMap. (While the activity of updating the map is done by volunteers and is not itself a commercial activity, as OpenStreetMap in an Open Data project the data in OpenStreetMap must be available for others to use commercially.) The conditions you have placed on the re-use will therefore restrict the way in which the information can be re-used.

You will be aware that Regulation 12(2)(a) of The Re-use of Public Sector Information Regulations states that any conditions imposed on re-use must not "unnecessarily restrict ... the way in which a document can be re-used". So if you wish to only allow use under the Non-Commercial Open Government Licence, you will need to demonstrate why the additional "non commercial" restrictions you have imposed are "necessary". On this point, I would refer to to ICO Decision notice FS50630368 available at https://ico.org.uk/media/action-weve-tak... which ruled on a similar request I previously made. In it the ICO found that you needed to licence the information under the Open Government Licence.

I would therefore invite you to reconsider the licence you have granted. Preferably, I would like to be able to re-use the information under the standard Open Government Licence v3. If that is not permitted, then please also consider giving specific permission for the information to be used to help update OpenStreetMap. Any required attribution statement / disclaimer can be provided to go on the page at https://wiki.openstreetmap.org/wiki/Cont... .

If you do not grant a more permissive licence, then the information about Post Offices that is already in OpenStreetMap will not be kept as up to date as it could be. It is odd that you would want this to happen, given your concerns about the currency of the information once released.
