Pooled Business Rates Funding for Thetford Enterprise Park Roundabout

Dear Breckland District Council,

I am writing to request some information regarding the £450k Pooled Business Rates funding that was awarded to Breckland District Council around January 2017, to be put towards the design and construction of the TEP Roundabout in Thetford.

In relation to this, please supply me with copies of:

1/ The request/application documents sent by Breckland;

2/ The offer/award letter sent to Breckland granting/agreeing to the funding, including the details of any conditions imposed;

3/ The acceptance/acknowledgement letter/document sent by Breckland confirming the acceptance of the funding;

4/ Any further correspondence from Breckland relinquishing or returning all or part of the funding.

I would also like details of any expenditure made/claimed against this funding so far, and any expenditure budgeted to be made against the funding in the future, including any amounts which were were previously so budgeted, but have since been re-assigned elsewhere.

Dear Breckland District Council,

I am writing to you concerning a request for information that I sent to you on 30 January 2019 concerning the Pooled Business Rates Funding for the Thetford Enterprise Park Roundabout. Since my request fulfilled the requirements laid down under section 8 of the Freedom of Information Act, under section 10 of the same act Breckland District Council has a duty to respond to it "promptly and in any event not later than the twentieth working day following the date of receipt". It has now been more than 20 working days since you received my request, and I have not had a response from you or even an acknowledgement.

Please confirm that you are in the process of dealing with this request, and let me know when I might expect to receive your response. Please also explain why you have failed to respond within the statutory timescale.

Many thanks for your acknowledgement of my FOI request about the TEP Roundabout funding, which you have assigned the reference number BFOI-006799.

As I am sure you are aware, requests for recorded information sent to a valid email address belonging to a Public Authority are valid under FOI, and you cannot only accept requests made via your online form. Since my request was sent to an email address ([email address]) that was (and in fact still is) published on your website at https://www.breckland.gov.uk/article/338... and there was no auto-response saying the address was unmonitored, the date that my request was received for the purposes of FOIA is the date the email was accepted by your mail system, namely 30th January 2019. Please confirm that this is the date of the request that is recorded in your systems.

This date means that your response to my request is now significantly over-due. I appreciate that this puts you in a difficult position, as the Council may have only become aware of the pending request just over a week ago (see https://twitter.com/rjw62/status/1100895... ). Nevertheless, I hope you will be able to respond much more quickly than 20 working days from the date of your acknowledgement. The first three parts of my request should be entirely straightforward, so I think the end of next week (Friday 15th) would be a reasonable time by which you could provide a response to them. I would appreciate it if you could answer these parts first, and supply the fourth part later if the latter would hold things up.

I would like to firstly re-iterate our sincerest apologies for this
administrative error and oversight. We usually promote our FOI web forms
in the first instance as they link directly into our back office system
which ensures instant acknowledgment and assignments as well as faster
responses due to less processing time internally but where an email

email address I understand you have now been provided with, unfortunately
in this change of process we appear to have missed the removal of the
[2][email address] from the web page you have
mentioned. Thank you for bringing this to my attention, my Team are
currently working to update this page and rectify this issue.

 

In the instance of this address receiving any mail, my understanding from
our IT department is that an undeliverable message will be sent back to
the sender, so I apologise that this has not happened in this instance as
from your perspective the request was submitted.

 

I have spoken with the teams dealing with this request and they are aiming
to have you the full response by the end of next week, however if there
are any issues or we can only provide you with parts of the response as
