Policy on repairs
Dear Northern Ireland Housing Executive,
Can you please provide details of your policy and legal position in regards to repairs to items and installations not installed by Housing Executive staff or by staff under contract to the Housing Executive?
Specifically, can you provide the legal background and current legal position in regards to the Housing Executive's duty to repair items that were installed in a NIHE tenancy by a former tenant to which the current tenant has no relationship?
Can you advise how unauthorised installations are dealt with at the end of a tenancy?
Can you advise if potential tenants are notified in writing of items to which the Housing Executive's repairing obligation does not apply, including items installed by previous tenants, prior to agreeing to take on a tenancy?

I am writing to request an internal review of Northern Ireland Housing Executive's handling of my FOI request 'Policy on repairs'.
I do not feel that the third or fourth questions in my original request have been answered in your response, and I repeat them below in the hope that you will answer them as part of this internal review, and will provide additional information which will hopefully help you to answer these.
Can you advise how unauthorised installations are dealt with at the end of the tenancy? (E.g. are these removed at the Housing Executive's cost, are they inspected to ensure they comply with required standards, is the outgoing tenant charged for the removal of said installations) Can you please provide guidance which illustrates the Housing Executive's position.
Can you advise if potential tenants are notified in writing of items to which the Housing Executive's repairing obligation does not apply including items installed by previous tenants, prior to agreeing to take on a tenancy? (I am interesting in finding out if a potential tenant is fully informed of the items they will be responsible for - the general conditions of tenancy give general terms, but it seems very important to notify a tenant in advance of any particular exceptions to these conditions in the dwelling they are offered - this could be classed as providing misleading information under consumer protection legislation if NIHE does not disclose that certain items, such as showers, doors etc, will not be repaired by the landlord if they develop faults)
