ICO Section 8 Guidance states:

In the case of a company, it is not necessary to provide the full registered name. It will be acceptable to provide another name which exists as a real entity, such as a trading name.

Also under the guidance an email address is considered sufficient under the DPA for an address.

FOR CLARITY:
The Advocacy Fund is the Name of the organisation that is managed by Advocati Massa Ltd (Reg In England), who appoints it officers. Both are Not for Profit Organisations.

Both are real names in law and this FOI request is therefore compliant with the FOI Act and section 8 Guidance.

RE:     Freedom Of Information Act 2000 – INFORMATION Request

We acknowledge your request for information about adoption received on the
25 May 2012. Please accept the Councils apologies for the delay in
acknowledging your request, the Freedom of Information Officer has been
out of the office.

We are considering your request and you should receive the information
requested within the statutory timescale of 20 working days, unless the
information is exempt or we require additional time to consider whether
disclosure is in the public interest in accordance with Section 2 of the
Freedom of Information Act.  

The information will normally be provided in paper copy, normal font size.

The Act defines a number of exemptions which may prevent release of the
information you have requested. Before we provide the information we will
consider whether it is proper to release it and if any of the exemption
categories do apply then the information will not be released. We will
tell you if this is the case, and you will have a right of appeal.

If the information you request contains reference to a third party then
they may be consulted prior to a decision being taken on whether or not to
release the information to you. We will tell you if this is the case.

You may have to pay a fee for this information. We will consider this and
let you know. If so you will have to pay the fee before we process and
release the information. The 20 working day time limit for responses will
not start until we receive your payment.

A.        The policies and procedures which relate to social services
removing children from the care of their parents. Merthyr Tydfil County
Borough Council works within the requirements of the Children Act 1989,
Volume One (revised) of the guidance relating to the Children Act 1989,
The Public Law Outline, ‘Working Together: Safeguarding Children under the
Children Act 2004’ in relation to the protection of children. 

 

All of these documents are publicly available on the Office of Public
Information and / or Welsh Government websites respectively.

Our core policy is the All Wales Child protection Procedures which is also
publicly available but a copy is attached.  Any decision to remove
children from their parents is undertaken as a process of assessment in
line with these statutory requirements.

B.        The criteria which has to be fulfilled to make a child eligible
for being adopted out of a parents care –

 

This is the threshold criteria in the Children Act 1989 and determined by
the court within care proceedings.

C.        What psychological assessments are used on the parents? (or
other assessments) and a copy of a blank version. A copy of our template
for initial and core assessments is attached – these include a section on
parenting. 

 

The Department does not undertake psychological assessments on parents
although these may be commissioned as part of care proceedings by the
various parties involved. There is no set template for this and the
instruction is determined, by the court, according to the particular needs
of the case.
