Dear UK Border Agency,

In August 2009 you implemented a policy known as "evidential flexibility" in relation to applications under the PBS.

Please may I have a copy of any Immigration Directorate Instructions, Caseworker Instructions, Interim Caseworker Instructions or policy guidance documents relating specifically to this policy, including the versions that are no longer in use (or those which have been superseded by other versions.)

I am writing to request an internal review of UK Border Agency's handling of my FOI request 'Policies and Instructions Issued In Relation To Evidential Flexibility'.

You dealt with the matter as a routine inquiry rather than within the provisions of the FOI. You kindly provided the current Process Instructions which I believe have been in force since March 2011. However I specifically requested a copy of each version of the instructions that has been issued since the inception of the policy in August 2009, together with any other related policy documents.

I would be grateful if you would treat this formally as a request under the FOI rather than as a routine enquiry and provide all documents and instructions that have been issued to your staff in relation to this policy since 2009.

I am writing to request an internal review of UK Border Agency's handling of my FOI request 'Policies and Instructions Issued In Relation To Evidential Flexibility'.

I'm afraid I am requesting yet another review as I do not believe you have provided me with all the documents I requested.

In his report "An inspection of Tier 4 of the Points Based System (Students), April – July 2012" at section 4.64, the Independent Chief Inspector of Borders and Immigration notes that there appears to be a specific instruction in relation to those students who are requesting entry clearance to attend high status universities such as Oxford or Cambridge.

For the third time - and with an intervening complaint that was made to the Information Commissioner - I find myself having to request copies of documents that should be in the public domain and available from your website. I am shocked (but not surprised) that you have failed to provide me with ALL process instructions, policy documents and other materials in relation to Evidential Flexibility even after the Information Commissioner's intervention.

If you do not intend to provide them, please state so in terms, and provide an explanation as to why you believe that they should not be furnished.
