This is a formal request under Freedom of Information Act 2000.

I should be grateful if you could, please provide copy of the following documents:

1. CQC's current Investigations Code/Guidance of Practice, and the copy of the Investigation Code for year 2004

2. CQC's current Memorandum of Understanding with Health and Safety Executive and the copy of the previous memoranda if you have them, please.

3 CQC's Memorandum of Understanding with the General Medical Council
valid for periods 2003-2012

4. Current CQC's Memorandum of Understanding with police/Home Office

5. Current CQC's Memorundum of Understanding with Monitor

6. Current CQC's Memorundum of Understanding with NHS

7. CurrentCQC's Memorunda of Understanding with Department of Health

8. How many memoranda of Understanding are there with CQC currently in force?

9. Copy of Code of Practice/Policy on Data Retention/Destruction from 2003 to current date

10. Copy of Complaints procedures for complaints against CQC staff valid in 2004 and a copy of the current policy

11. CQC's Freedom of Information Act Code of Practice/Policy current and the copy of policy valid in 2004.

I am writing to acknowledge receipt of your request for information and to
request clarification before we can proceed with your request for
information dated 03 September 2012, which the Commission received on the
same day.

 

The Commission requires the following points of your request to be
clarified.

 

Clarification required for questions 1, 2, 3, 9, 10 and 11

 

The CQC has only been operational since April 2009 so there are no CQC
documents dating back prior to this.  In questions 1, 2, 3, 9, 10 and 11
you request data going back to 2003/2004.  Please can you advise whether
you require us to provide data relating to CQC - i.e. going back to 2009?

Dear Ms Blakeley,

Thank you for your reply of 4-9-2012.

1. I understand you are seeking clarification for questions 1, 2, 3, 9, 10 and 11 that I posed:
"The CQC has only been operational since April 2009 so there are no CQC

I should be grateful if you could provide data going back to CQC's predecessor as I understand you are both at the same place and organization changed name only and some staff and some policies, but essentially it is the same regulator. I would think HR and legal department would have previous policies.

2. Do you need any other clarifications?

3. You say there is a list of some policies on website but no actual text. I am looking for the text of the policies, please.

With respect to my request under FOIA dated 3-9-2012 under point 12, please note that I asked for copy of ISA. You have provided me with the link to CQC website where there is no copy of ISA but just a list of ISA.

Please, provide scanned copies of all the current ISAs.

Dear Ms Blakeley,

1. Having checked the information you provided so far I have noted that there is no MoU between CQC and NHS. Please, confirm this is the case.

2. There is no MoU between CQC and Department of Health. Please, confirm this is the case if it is.

3. How many MoU are currently in use by CQC? It is not possible to conclude what the number is from the links you have sent me so far in case some may not be published on your website.

4. It is not possible to open some of the PDF files of MoUs on the CQC website. The following give message as being corrupt files:

a) MoU between CQC and OFSTED
b) MoU between CQC and Local Ombudsman
c) MoU between CQC and EHRC
d) MoU between CQC and NMC
e) MoU between CQC and Civil Aviation Authority

If you have the copies of these, please, scan and disclose if these are currently valid.

5. I have read Code of Practice on Confidentiality but that is not the same as Policy on Data Retention and Destruction as it does not include Records retention and Disposal Schedule. Please, provide a copy of Records Retention and Disposal Schedule which is current.

I am writing to acknowledge receipt of your email dated 03 September 2012,
which CQC received on the same day.  Thank you for providing clarification
of your request and additional questions in your emails dated 19 and 21
September.

 

Please note that my email dated 4 ^ September was not intended as a formal
response to your Freedom of Information request but to signpost you to
some information already publicly available that you may find helpful. 

 

I note that you were unable to open some of the MOU’s on our website – I
have checked the links and they now appear to be working.  Please accept
my apologies if you experienced difficulties opening them.  I have
attached PDF copies for your information.

 

Clarification provided

 

You have advised that you would like the data requested to go back to
CQC’s predecessor bodies.

 

It may be of assistance to you to know that CQC was formed when three
separate Commissions each regulating different areas of health and social
care merged into one Commission in April 2009.  The Commissions were: the
Healthcare Commission, Commission for Social Care Inspection and Mental
Health Act Commission.  Prior to this merger each individual Commission
had also superseded earlier Commissions.  

 

 

Addition to original information request

 

In your email dated the 21 September you asked some further questions
which will be incorperated into our response to your original request.

 

You asked:

We will write to you before this deadline if we are unable to meet it.

 

The information you have requested may be subject to an exemption from the
right to know. Should this occur, you will be notified accordingly when we
write to you next.
