Dear Essex Police,

Please can you inform me of benefits received by a random and anonymised sample of 12 police officers of all ranks up to Chief Superintendent serving with you from Tesco PLC and selected as follows.

Officers on a given and convenient date within four weeks weeks of receipt of request to be placed in alaphabetical order by family name with the 50th and every 3rd officer thereafter to be interviewed to give the details of any benefit received including the percentage of any discount on goods and services

reference. Having completed my enquiries I am able to respond as follows:

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at
Sec1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Sec1(1)(b) is to disclose information
that has been confirmed as being held. Where exemptions are relied upon
s17 of FOIA requires that we provide the applicant with a notice which: a)
states that fact b) specifies the exemption(s) in question and c) states
(if that would not otherwise be apparent) why the exemption applies.

In respect of your enquiry:

Please can you inform me of benefits received by a random and anonymised

This information is not held by Essex Police and your suggestion that we
interview officers for the purposes of your enquiry is outside the scope
of FOI.

 

FOI legislation relates to the provision of recorded information held by
Public Authorities and we are not required to create new data for the
purposes of answering FOI requests. Selecting a sample and the
interviewing officers would clearly involve the creation of new data.
