Dear Sir or Madam, Iam making a request for all the information to
which I am entitled under the Freedom Of Information Act. In order
to assist you with this request, I am outlining my query as
specifically as possible. If however this request is too wide or
too unclear, I would be grateful if you could contact me by e-mail,
as I understand that under the act, you are required to advise and
assist requesters.

I would like to know:

1. Who is personally reponsible(postion within organisation reporting of course to Chief Officer) for deciding to reduce injury awards to police pensioners once they have reached 65 years of age.
2. Who is responsible( once again position only required) for deciding on 'cogent reasons' not to reduce injury pensions to;
a. Those pensioners over 60 years.
b. Those pensioners over 65 years.
3. What is the definition of a 'cogent reason' as used by Northumbria Police.
4. What is the cost to the police of a 'face to face' consultation with an SMP as opposed to a paper decision.
5. Does the Force still use the National Average Earnings figures in its calculations of pensions at age of 65 yrs.
6. Does Northumbria police have its own guidlines to the review of injury pensions - will you disclose them in full.
7. How many times since January 2008 have 'cogent reasons' been accepted? and what were these cogent reasons (redacted information is acceptable of course)
8. Which company provides occupational helath advice to the force on serving officers and staff.
9. Which is the independent company that provides advice to the force on reviews of injury pensions.
10. If these are one and the same company does the SMP have anything to do with such OH advice to Northumbria Police employees.
11. Have any discussions with IOH and the SMP raised Northumbria Police's concerns with the level of injury awards currently in the Force and its effect upon the budgets. If these meetings are minuted could I have a redacted copy.
12. What is the calulation used to enhance post 60 years pensions in line with HO recommendations to reflect additional qualifications etc and employibility.

Thank you for your email dated 16 June 2009 in which you made a request for
access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

1. The authority to review awards is given to the Police Authority who
delegates this authority to the Chief Constable. Northumbria Police will
decide whether to review injury awards however it is the decision of the
Selected Medical Practitioner (SMP) as to whether an injury award is
reduced.

2. SMP are responsible in both cases.

In relation to the above, the Force can make recommendations to the SMP
regarding cogent reasons based on information provided by those subject to
review however it would ultimately be the decision of the SMP.

3. There is no definition of a cogent reason available, this is a matter
for the SMP's judgement.

4. The costs are identical since Northumbria Police have an existing
contract with IOH who perform this function and therefore individual tasks
are not costed separately

5. There is no comparator used for pensions at age of 65.

6. Injury awards are dealt with by an Injury Award Team who will look at
each case periodically and on an individual basis. We have in-house
administrative procedures relating to injury award reviews, I have provided
a copy for you below.

7. None.

8. Industrial Occupational Health (I.O.H.)

9. I.O.H., however other companies are used where there is considered a
conflict with the I.O.H.

10. I.O.H. provides medical advice in relation to Police Officers and
employees of the Police Authority under the direction of the Chief
Constable.

11. There are no records of such discussions taking place.

12. Calculations form part of a Potential Earnings Report completed by HR
at the request of the SMP. Any additional qualifications or experience
gained would be taken into account when completing this report.

Could you clarify one or two points which in the light of experience, and a meeting withe the Doctor.
1. The SMP is not given the decision role over COGENT REASONs - he has no role in the matter - who now has?

Dear Sir,
In response to the above question Northumbria Police stated that the Selected Medical Practicioner DECIDES upon cogent reasons for post60yrs and post 65yrs review.
An interview with Dr Broome finds that he does neither - in fact he states he merely 'signs off' decisions from a member of the Pension Review team. Likewise in letters from the Police Authority they insist that the matter of pensions review and cogent reasons are dealt with independently by Dr Broom.

In a further twist the Chief Constable in a letter two days ago states that HR decide on cogent reasons and that the decision is used by the SMP to set the level of disability.

Can you tell me exactly what regulation or HO guideline allows HR to decide on cogent reasons?

The review is of the original request which is obviously wrong ie the SMP does not decide on cogent reasons in NP. The letter from the CC states you decide and the SMP has confirmed this with me. He states he signs the decision made by your Pension Review Team.
At least we have clarity in your process - I just want that confirmed as the original FOI request now appears misleading.
I would also dearly love to know what Regulation or Act or HO guidance allows HR to decide on such issues without the benefit of an Independent Assessment.

Dear Helen,

All I want to know from the Northumbria Police is
1. What Regulation or HO Guidence is used to allow the HR department to decide on 'cogent reasons' for the benefit of reducing Injury Pensions, as opposed to the guidance from the Home Office that states the SMP is the person who decides.This is the basis of the review - the reponse I originally received was that the SMP alone decides on cogent reasons, the Force may well 'advise' but the smp decides. This appears to not be the case now.

2. I have been asking for over 6 months now for the figure used instead of pensionable pay ie the figure described as being the NAE from ASHE.
This would be to determine pensioners reduced pension after the Compulsory Retirement Age of 55/60 yrs, depending on when you retired.
I know the description used is 'average' but there is a much deeper meaning. All I want is the actual monetary figure used by the HR between October 2008 and now, in pounds, not percentages or descriptives. The figure, according to an in force memo is freely available....to staff.
I don't know if I can make it any clearer!

The group has members from many of the forces worst affected by the implementation of new policy based on the infamous Home Office circular 46/2004.

We have now had the opportunity to fully consider your request and I

1. Only the Selected Medical Practitioner (SMP) can determine
whether any evidence is adequate for an SMP to base his conclusions on.
The decision rests with the SMP alone, subject to various common law and
statutory rights of appeal. No-one else is permitted by the Regulations
to make this decision.

2. The National Average Earning (NAE) figure used by Northumbria
Police is **28,856.

The formula used is the formula, which appears in the Police
Pension Regulations. Once a former officer reaches what would have been
the compulsory retirement age (CRA) for their rank, their comparator
salary ceases to be their former police officer salary and is replaced
with National Average Earnings (NAE), which is lower. CRAs recently
changed. Officers keep the CRA for these purposes, which applied at the
time they retired.

The information we have supplied to you is likely to contain intellectual
property rights of Northumbria Police. Your use of the information must
be strictly in accordance with the Copyright Designs and Patents Act 1988
