access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

A copy of the submission is attached. Please note that this document is
protected by copyright and no permission is given to reproduce the document
or any part of it by any means. We will not be disclosing the document in
its entirety and have made suitable redactions. In doing this we will rely
on the following exemption:-

Section 31(1)(a)(b)(c) Law Enforcement

Section 31 is a prejudiced based qualified exemption. This means that the
legislators have identified that the harm (prejudice) in disclosure needs
to be documented and the public interest in disclosure should be
considered. The result of both the harm and public interest test (PIT)
should be articulated to the applicant, and we have set this out below.

Harm

Modern-day policing involves the ongoing assessment of crime levels
throughout the force area; such assessments can assist the force in aiming
its resources more effectively in order to combat crime. Whilst this data
can assist the force in deploying resources, the publication of such
assessments could provoke a negative reaction within the community.

Public Interest Considerations

Factors Favouring Disclosure

It could be argued that if this information was disclosed it would provide
a better understanding and awareness to the community which may reduce
crime and lead to more information (intelligence) being provided to the
police.

Factors Favouring Non-Disclosure

To reveal the assessment of the area out of context could serve to provoke
disorder within the community and ultimately put members of the public at
risk.

Balancing Test

The Northumbria Police Service has a duty of care to the community it
serves to ensure effective law enforcement is delivered. The prevention
and detection of crime is of paramount importance to the Police Service and
information will not be disclosed which would undermine such a process.
Therefore, at this moment in time, it is our opinion having conducted a
balancing exercise, the public interest in non-disclosure of this one
sentence outweighs the public interest in its disclosure.
