I write in connection with your request for information dated 2nd July 2009, which was received by Nottinghamshire Police on 2nd 2009, I note you seek access to the following information:

Can you please provide me with the current Force Instructions or

similar document(s) in relation to the Welfare and Care of Police

Dogs with the Nottinghamshire Police Service.

Your request will now be considered in accordance with the FOIA. You will receive a response within the statutory timescale of 20 working days as defined by the Act, subject to the information not being exempt or containing a reference to a third party. In some circumstances Nottinghamshire Police may be unable to achieve this deadline. If this is likely you will be informed and given a revised time-scale at the earliest opportunity.

There may be a fee payable for the retrieval, collation and provision of the information you request. If this is the case you will be informed, in writing, and the 20 working day timescale will be suspended until we receive payment from you. If you choose not to make a payment then your request will remain unanswered.

Some requests may also require either full or partial transference to another public authority in order to answer your query in the fullest possible way. Again, you will be informed if this is the case.

Quite worrying when a Police Force asks a member of Public for clarification of a request when it is simple and straight forward!!!

Under S 1 (3) (a) of the FOIA, I require clarification of your request.

Under S 1 (3) of the FOIA -

“Where a public authority -

1.

reasonably requires further information in order to identify and locate the information requested, and
2.

has informed the applicant of that requirement,

Please could you give more description of the content of the documents you require.

Nottinghamshire Police is not required to comply with your request until further information has been supplied. Therefore the 20 working days has stopped until sufficient information has been received.

Dear Coryn,

I am having trouble understanding how I can provide clarification of my request given it the clear and precise way in which I provided my FOI request.

I trust that you are not simply introducing a 'delaying tactic' in response to my request in order to 'stop the clock' and gain further time in responding to my legitimate request.

I am seeking a copy of all documents that the Force holds in relation to the welfare and care of Police dogs in Nottinghamshire Police Service. These documents would include any guidelines on the physical and emotional welfare of animals including the transportation and accommodation of those animals.

I would imagine the documents I seek would include (but not be limited to) the Force guidelines and/or policy documents/and/or 'Standing Orders' issued to Police Dog Handlers/Training Departments/Training Officers.

I would remind you of your duty under the FOIA to 'assist' enquirers whenever possible and as I not in a position to know what documents you possess I can only ask that you provide me with a list of ALL documents that exist in relation to the above matters.
