We're waiting for Federica Bordaberry to read a recent response and update the status.

Under the FOI Act I would like to request the following information:

Which items or goods were sent to Police Auctions from the West Midlands Police, from 2010 to the present date (29 October 2022).

Please provide a discrimination of the information with
- Type of item (ex. car, wallet, luggage, etc.)
- When did the Police find it
- When was it sent to auction
- How much money was it sold for
- If it was sold to a person or to a company (if you hold that information)
- How was the item/good obtained by the Police (ex. lost luggage at train station)

Please provide this information in spreadsheet format (CSV or XLS).

REQUEST

 

Which items or goods were sent to Police Auctions from the West Midlands

RESPONSE

 

Our data are not organised in such a way as to allow us to provide all of
this information within the appropriate (cost) limit under the Freedom of
Information (FOI) Act. In relation to the requested 10 year time period
and questions b), c), e) and f), this information is not centrally
collated. This is because multiple departments across the force hold
different information relating to auctioned items. Therefore, to answer
all of these questions we would need to separately liaise with each of the
relevant departments (depending on the specific question) and cross
reference their records with each other in order compile a complete
dataset for this request. To conduct all of these searches however would
exceed the appropriate limit (FOIA, s.12). 

 

This means that the cost of providing you with the information is above
the amount to which we are legally required to respond i.e. the cost of
locating and retrieving the information exceeds the ‘appropriate level’ as
stated in the Freedom of Information (Fees and Appropriate Limit)
Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of the request and if one part of a
request exceeds the fees limit then S12 of the Act applies to the whole
request.

 

However, under Section 16 of the Act I have a duty to provide advice and
assistance in relation to your request and can advise that within the cost
limit we could conduct a search for property that has been sold at auction
over the last 4 years (since we have been with our current auction
contractor), broken down by the type of item and how much it was sold for.
Please note that any located information might be subject to the
application of exemptions under the Act.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to undertake the search outlined above. After
receiving your reply, your request will be considered and you will receive
a response within the statutory timescale of 20 working days, as defined
by the Act, subject to the application of any statutory exemptions. If you
chose not to respond then your request will remain unanswered.
