EXTENT OF SEARCHES TO LOCATE INFORMATION

To locate the information relevant to your request searches were conducted
at The Counter Terrorism Command.

RESULT OF SEARCHES

The searches located records relevant to your request.

DECISION

In order to provide you with a bit of background information The National
Public Order Intelligence Unit NPOIU, the National Extremism Tactical
Coordination Unit (NETCU) and the National Domestic Extremism Team (NDET)
amalgamated to become known as the National Domestic Extremism Unit
(NDEU). In 2011 the NDEU became part of the MPS.

In response to your request, I have today decided to disclose the located
information to you in full.

Please find below information pursuant to your request above.

(C) As of 01/11/2013 there were 3880 images/photos on the database.
 Please note that this figure not only include photos, but also other
scanned documents.

(D) The most senior ranking officer within the unit is a Detective Chief
Superintendent.

1) Old Oak Common Lane

to deal with the windscreen washers on the A40. Dispersal zone in
place until January 2014

2) Eel Brook Common

 to deal with groups of youths congregating and causing harassment,
alarm and distress to members of the public. Dispersal zone expired on
the 14th November

I write in connection with your numerous requests for information which
have been received by the Metropolitan Police Service and logged under the

DECISION

Pursuant to the provisions of Section 14 of the Freedom of Information Act
2000 (the Act) I have decided to refuse these requests as they have been
deemed  “Vexatious Requests”.

REASONS FOR DECISION

Section 14(1) of the Act provides:

Section 1(1) does not oblige a public authority to comply with a request
for information if the request is vexatious.

The Freedom of Information Act 2000, (FOIA), is legislation designed to
give individuals access to information, subject to any relevant
exemption(s), held by public authorities.  The spirit of FOIA is openness
and transparency and, rightly, opens up public authorities to greater
scrutiny and accountability.  It also exists to keep the populace better
informed regarding matters which affect them.  The legislation is not
designed as a tool to be used on fishing expeditions and although free to
the applicant its delivery is not without cost to the authority, and
therefore indirectly the taxpayer.

It is only right that the Metropolitan Police Service (MPS) should use its
resources wisely when managing Freedom of Information requests and
principles have been established within the judicial framework of the
legislation to protect authorities when requests are a burden on its
staff, have no serious purpose or value or harass and/or distress staff.
 It is vital that the motives of the requestor are taken into account when
considering these issues. See IC v Devon County Council and Dransfield
[2012] UKUT 440 (AAC)

The ruling of the Tribunal found that a 'vexatious' request is one that is
manifestly unjustified, inappropriate or an improper use of the FOIA
procedures, which hinge upon four key, but not exhaustive principles:

(1) The burden - on the public authority and its staff. This involves
considering the previous course of dealings with the requestor, looking at
factors such as the number of requests, their breadth or the pattern of
their arrival, plus as quoted in the Information Commissioner's Office,
(ICO), guidance "…likely to cause a disproportionate or unjustified level
of disruption, irritation or distress."

(2) The motive - of the requester. That FOIA is "motive blind" does not
mean that there can be no examination, under s14, of the justification for
the request, or its motive. It may be "ill-intentioned", or have drifted
so far from its original purpose as to become disproportionate.

(3) The value or "serious purpose" of the request. The UT recognised the
potential for overlap with (2), and also cautioned about "jumping to
conclusions" about a lack of serious purpose; but there should be an
objective public interest in the release of information sought.

(4) Any harassment or distress, of and to staff - by the use of bullying
language etc. This was not, however, a prerequisite for the application of
s14.

Pursuant to the provisions of Section 14(1) of FOIA, I have decided to
refuse your request as it has been deemed a 'Vexatious Request'.
 Therefore, Section 1(1) does not oblige the MPS to comply with a request
for information if the request is vexatious.

In reaching this decision as well as considering the judgement within the
Dransfield Tribunal decision the MPS has also considered recent guidance
from the ICO in regard to Section 14(1) requests.  The MPS has received 30
requests from you and another individual which appear to form part of a
campaign.  These requests cover a wide variety of subjects and business
areas across the MPS to include: Unit workloads, staffing levels,
promotion prospects of certain ranks, car parking spaces, vehicle
markings, pursuit guidance, uniform equipment, cash seizures, officer
briefing facilities and the difference between certain types of hi-viz
jackets. Every single request involves research and investigation in order
to establish what information is held and if held consideration as to
whether or not it is suitable for disclosure.

The ICO guidance makes it clear that requests which are completely random
and solely designed to be fishing for information are unacceptable. This,
the MPS believes is clearly evidenced by the requests you have submitted
on a wide variety of subject matters. The requests appear to be part of a
completely random approach, lacking any clear focus and serious purpose.

Therefore this letter acts as a refusal of your request as it has been
deemed a "Vexatious Request" This has been decided because of the overall
burden on MPS departments in processing 30 FOI requests received which
appear to form part of a campaign.
