POL Private Prosecutions of SPM based on Horizon Evidence

Dear Department for Business, Energy and Industrial Strategy,
I have asked the Ministry of Justice for information on PO prosecutions, they gave this reply, therefore :
Thank you for your request dated 18 November 2021 in which you asked for the following
information from the Ministry of Justice (MoJ):
Please can you say when your department first became aware of the number of
Spm's POL was prosecuting for losses produced from Horizon data alone? Can you
also say when you became aware of the process POL was employing to coerce SPM
into pleading guilty when no evidential test could be met?How was a government
dept(POL is entirely owned by the Government)able to brimg private prosecutions
and not public ones?Does your dept have oversight over the Courts? In your role as
The organisation that works together and with other government departments and
agencies to bring the principles of justice to life for everyone in society what
information have you exchanged with POL,BEIS and UKGI concerning Horizon
prosecutions?

The MoJ does not hold any information in the scope of your request. This is because we are
not the appropriate authority to contact on this subject. Policy matters concerning the Post
Office Limited (POL) cases is being led by the Department for Business, Energy and
Industrial Strategy (BEIS)"

Yours faithfully,

Dear FOI Requests,
It is sad that on the day Sir Wynns Inquiry into the Horizon Scandal started hearing victim testimony this question is yet to be answered. In an attempt to see what if any scrutiny POL faced when prosecuting hudreds of SPM;s can you please answer the two questions that both the Attorney General and the Ministry of Justice state fall under your leadership. When did you learn of the number of POL prosecutions? When did you learn of the methods employed by POL to obtain Guilty pleas?

Yours sincerely,

john o'sullivan

Dear FOI Requests,
I am still waiting for a reply to a FOI request you acknowledged on 15th December 2021.Both the Attorney General Office and the MOJ assure me your department has oversight of POL actions in order to answer the two questions raised. To that end can yo please say when your Department became aware of the number of Prosecutions POL were bringing against SPM and when you became aware of the procedures used to coerce SPM into pleading Guilty

Yours sincerely,

john o'sullivan

Dear FOI Requests,
May the fourth be with you!In an attempt to understand how POL got away with being judge, jury and executioner I asked The Attorney General and the MOJ questions concerning POL prosecutions of Spm's.They have both stated oversight of POL is your departments responsibilty. To that end can you please answer the questions,When did you first know of the number of SPM POL was prosecuting and when did you learn of the tactics employed to coerce individuals to plead guilty to lessor crimes?

Yours sincerely,

john o'sullivan

Dear FOI Requests,Can you please answer these questions or if the Ministry of Justice and the Attorney General's Office are incorrect in their advice suggest what I might reasonably be expected to do,thanks

Dear FOI Requests,Thank you for a reply. This is a long running search for information.I first asked The Attorney Generals's Office what information it held on the private Prosecutions of SPM's based on Horizon evidence and the methods employed to obtain Guilty pleas. They advised me to ask the Ministry Of Justice who in turn explained that oversight of POL actions is a matter for your Department. These prosecutions have been found to be "an affront to the Public Coscience" and the largest miscarriage of justice in UK Legal History at the same time when you had a seat on the Board and strategic oversight of POL.So when did you first become aware of the number of SPM'S POL were prosecuting and when did you become aware of the methods employed by POL to gain guilty pleas?

Yours sincerely,

john o'sullivan

Dear Department for Business, Energy and Industrial Strategy,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Business, Energy and Industrial Strategy's handling of my FOI request 'POL Private Prosecutions of SPM based on Horizon Evidence'.

[ GIVE DETAILS ABOUT YOUR COMPLAINT HERE ]I first asked this question in December 2021.How can it take 8 months for you to decide it will be expensive to answer. When did you first know of the number of prosecutions POL were bringing against SPM?When did you learn of the techniques they employed to persuade SPM to plead guilty to crimes they had not commited?I am sure Sir Wyn will want these questions answered as well so why not say?

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...

Yours faithfully,

john o'sullivan
