Dear Councillor Crabb,

On the BBC Points West piece this week:

Councillors were quoted anonymously.

I was guessing who the Councillor might be that signed up with IBM
for SW1 (at 2am on a Saturday morning back in late Sep'2007) but
stated (anonymously) to BBC Points West that "parts of SW1 were
working pretty well".

I can understand avoiding being identified on camera, but was that
you quoted anonymously?

Some IBM/SW1 parts that are NOT working so well for Somerset:

(£4m to get into SW1 with IBM; £5m to contract manage it; £30m
added to borrowings for SAP IT system; Extra £2.7m charges during
cuts from 2012 to 2017; 2012 IBM taking legal action against it's
own SW1 founding partner Somerset CC)

a1) Savings target missed by £87m after 5 years.

However, there are aspects in its financial
management that undermine this position, most notably delivery of
savings through the SWO contract, which are taking much longer to
deliver than first envisaged. SWO actual savings delivered of
£13.03 million (as at the end of June 2012) are well below the
Council's contract projections of £100.63 million (by 31 October
2012).

a2) Somerset Accounts Value For Money qualified by the District
Auditor for the first time!

3.4. Regrettably, the Council's arrangements for achieving value
for money have received a qualified conclusion for the first time.
This means that although the County Council has proper arrangements
in place to secure economy, efficiency and effectiveness, there is
an exception with regard to its arrangements for securing financial
resilience. Specifically, Southwest One is falling significantly
behind planned expectations in procurement savings and this is
having an adverse impact upon the Authority's Medium Term Financial
Plan.

Value for money (VFM)

I expect to issue a qualified 'except for' VFM conclusion.
I conclude the Authority has proper arrangements to secure economy,
efficiency and effectiveness in the use of its resources except for
the Authority's arrangements for securing financial resilience,
where I identified that savings and efficiencies to be delivered in
conjunction with its strategic partner, SouthWest One, are falling
significantly behind planned expectations and this is having an
adverse impact upon the Authority's
medium term financial plan.

b) The £30m SAP system is still not quite right over 3 years after
implementation & was built & configured offshore in IBM India; an
FOI shows that the promised skilling of Somerset IT staff has been
basic, with key certificated skills & 2nd/3rd line support
offshored to India (IBM GSI Bangalore).

c) Health & Safety risk created by IBM/SW1 for Somerset in Property
and Facilities Management:

d) None of the £33m more expensive IBM Variant Bid deliverables
promised for the stimulation of Somerset's economy have arrived.

e) In 2012, 25% less net jobs in SW1 (and less money in Somerset
local economy) than were transferred into IBM/SW1 in 2007

f) Right now, IBM/SW1 is taking it's founding partner Somerset
County Council to court!!

As current Leader of the Lib Dems in Somerset and the delegated
negotiator as Resources Portfolio Holder in 2007 (when this deal
was signed) will you now apologise to the people of Somerset for
the very poor outcomes by IBM/SW1, who are contributing to
austerity in Somerset and reducing funding for public services?

Dear Mr Orr

Thank you for your e-mail and the link to BBC Points West.
Interesting television viewing.

Unfortunately you have not got it right. I do not know if the
Councillor who signed the SWOne contracts at 4 am one morning said
what you quoted. This of course following a unanimous cross party
vote at a Special Meeting of Full Council, giving him authority to
sign on behalf of the Council.

Although I saw him this evening it was not a question I posed.

Following the County Elections in 2009 I think you will find that
it has been the Conservatives who are responsible for the poor
outcomes from SWOne and IBM. Whilst we were the Administration we
did our very best to achieve the best outcomes for the people of
Somerset.

the signatories to the contract were on behalf of SCC (Councillors and
Officers and any other parties).

 

Our Response

 

Please find attached redacted versions of the signatory pages of the
Southwest One Contract.

 

Where redactions have been made we have identified this with a black block
and the exemption made.  We judge this information to be exempt under
section 40 of the Freedom of information act.

 

Section 40 (2) (3) (a) (i)); Personal Information states that any
information to which a request for information relates is also exempt
information if—

 

(a) it constitutes personal data which do not fall within subsection (1),
and

 

(b) either the first or the second condition below is satisfied.

 

(3) The first condition is—

 

(a) in a case where the information falls within any of paragraphs (a) to
(d) of the definition of “data” in section 1 (1) of the Data Protection
Act 1998, that the disclosure of the information to a member of the public
otherwise than under this Act would contravene—

 

(i) any of the data protection principles.
