connected with the licensed taxi trade that have been conducted
under the Police and Criminal Evidence Act 1984 by your Licensing
Enforcement officers since January 2013, broken down into the
following categories:-

1) The total number of interviews under PACE conducted.

2) The numbers of interviews at which the above interviewees were
granted access to free and independent legal advice in accordance
with their rights outlined in Code C of the Home office PACE Codes
of Practice.

3) The number of interviews at which the presence of an unqualified
advisor in the form of a trade representative was refused by your
officers?

4) The number of interviews at which the presence of an unqualified
advisor in the form of a trade representative was allowed by your
officers.

5) The number of interviews at which the interviewee brought
his/her own qualified legal advisor.

November confirmed you required the information relating to Hackney
Carriage Drivers and Private Hire Drivers who for what ever reason are
interviewed under PACE SEC 60 and 66. This request has been considered
under the provisions of the Freedom of Information Act 2000 (FoIA).

I set out below your request for information and the Council’s response to
your request:

In your request you asked for the following information with regards to
Hackney Carriage Drivers and P/Hire Drivers who for what ever reason are
interviewed under PACE SEC 60 and 66

1) The total number of interviews under PACE conducted.
Answer: 158 - As clarified, this figure includes both tape recorded
interviews and pocket book interviews.

2) The numbers of interviews at which the above interviewees were granted
access to free and independent legal advice in accordance with their rights
outlined in Code C of the Home office PACE Codes of Practice.
Answer: The code makes it clear that the requirement to provide access to
free independent legal advice only applies in circumstances where a person
has been detained. As a Local Authority enforcement officer does not have
the power of arrest or to detain an individual this requirement does not
apply to Local Authorities. The answer to your question is therefore: Nil

3) The number of interviews at which the presence of an unqualified advisor
in the form of a trade representative was refused by your officers
Answer: 2

4) The number of interviews at which the presence of an unqualified advisor
in the form of a trade representative was allowed by your officers.
Answer: Nil

5) The number of interviews at which the interviewee brought his/her own
qualified legal advisor.
