Dear Curo Housing Group,

This request for information is similar to my earlier communication on 7th October. I thought it over and decided that it would be nice to have additional information.

In your financial statement for 2016, you state that you have three schemes approved by your board for regeneration. You say this in your document at this link (on page 45):

I would like to be given details of these please. In what areas will these regeneration schemes take place (e.g. Odd Down, Whiteway, Weston)? Will grassed areas of land be built on? Will trees and shrubs be removed?

What is and will be the housing composition before and after the regeneration work takes place? Are we to expect tall blocks of flats? Detached homes? Rows of social housing? What types of homes are to be demolished - so-called prefabs? These questions relate to the environment as they have implications for the visual aspect and in some cases the 'carbon footprint of homes' and air quality. For example, the thin walls of pre-fab homes typically result in more energy being expended to heat these homes.

What level of demolition is to be expected and how will the waste materials be deposited?

I understand that housing associations are not required to answer Freedom of Information requests. However, the law differs regarding the Environmental Information Regulations. These regulations state that requests for information should be answered by bodies that perform functions of public administration which affect the environment.

Regulation 2(2)(c) states that: Organisations perform functions of public administration if they have been given special legal powers to carry out services of public interest.

For example, in Fish Legal vs ICO and others, the tribunal found that water companies were subject to the Environmental Information Regulations , as they hold special legal powers such as the right to make compulsory purchases and to enter homes to maintain services. It seems to me that these legal powers are held by the Curo Housing Group also. For example, your planned regeneration of the Foxhill estate is expected to involve the compulsory purchases of homes: http://tinyurl.com/y7xr3db .

I am writing to request an internal review of Curo Housing Group's handling of my request for information: 'Please give details of the three schemes approved for future regeneration.'

I would like to state that I'm not doing this out of any spirit of animosity, but simply because I believe the public have a right to know the information.

Your responses to my requests for this information have been to say that Curo is a company not subject to the Environmental Information Regulations. I wish to contest that please.

Curo is classed as a housing association by the website whatdotheyknow.com that supports the public to submit hundreds of information requests on a daily basis. As I understand it, housing associations are private, non-profit making organisations that provide low-cost social housing. Therefore I would suspect that Curo can indeed be classed as a housing association.

In the past, the Information Commisioner has ruled that a housing association is a public authority within the meaning of Regulation 2(2)(c) and 2(2)(d)(i) of the EIR. See:

In which case, I believe you would be bound by law to supply the requested information.

The case you have cited is a Northern Ireland precedent and does not apply to housing associations in England where the legal context is different.

Thanks for your answer. But am I to assume from it that you are unprepared to conduct an internal review? In which case, I must raise a complaint with the Information Commissioner's Office.

As I am led to believe, the Information Commissioner will consider cases such as these on a case-by-case basis.

I do feel it would be a shame if a housing association like Curo can draw up plans to demolish homes and radically alter people's environment, without seeing any need to inform the public of those plans in advance. So I see a reasonable moral compulsion to take the matter forward.

Final outcome.

I did get some of the information I was asking for, one day after saying that I would take the matter to the Information Commissioners Office.

It's unclear why Curo chose to answer. I learned that the appeal to the Information Commissioner had a theoretical but unlikely possibility of success, as the legal context differs in England. A Whatdotheyknow volunteer told me that the team will review the advice they give on this site. Had the Information Commissioner ruled in our favour, I suppose it would have set an unwelcome precedent for this housing association.

A link to this thread was being circulated by a campaign group, applying some pressure. Also - I run a small scale community newspaper and could have applied pressure and 'bad press' that way.

Whatever the case, I found out that the three main areas for regeneration were:
1. Foxhill
2. St Chad's, Midsomer Norton
3. Some undisclosed place outside of Bath
Thanks to Curo for this information.

As the Communications Office rightly noted, my reasons for the information request was to check whether my own wider community at Twerton was about to be subjected to a 'hard' regeneration such as Curo's controversial plans for Foxhill. So I'm satisfied with the answer I got.
