Please Clarify Which Answer is True Regarding a Request for a Reasonable Adjustment

The request was successful.

Dear Dumfries and Galloway Council,

In response to two FOIs, regarding a reasonable adjustment under the Equality Act 2010, D&G Council said:

"... The relevant manager would seek input from ... the Council's legal services, in order to inform the Council's decision."

The Council also said:

"No requests made by any service users were received by Legal Services between June 2016 and November 2016, requesting a reasonable adjustment for intellectual impairment / learning difficulties under the Equality Act 2010." (Response date: 31 July 2017).

However, in response to a SAR under the DPA 1998, a service user was told:

(Regarding an application for such a reasonable adjustment):

" In relation to the legal advice sought by Social Work Services from the Legal Services, the Council can advise that anonymised personal data was processed between 18 and 19 July 2016 for that purpose."

Please provide the documentation that proves one of the assertions made by the Council is true, as evidently, the Council's assertions cannot be trusted without documentary proof to support them.

If, as asserted, the request made to Legal Services, was an anonymised request for the purpose of obtaining legal advice, then it won't infringe any service users right to confidentiality.

I understand that the giving and receiving of legal advice is exempt from disclosure. However, in this case it appears to be the only way to settle an important issue for the public: that it appears the Council deliberately gave a false answer to an FOI request.

Yours faithfully,

COLIN WHITE
