ENVIRONMENTAL INFORMATION REGULATIONS 2004 - INFORMATION REQUEST
 
Thank you for your request for information received on 5th November 2021.
We have considered your request and enclose the following information
 
Request to view the planning application and consultation for the play
park next to the B4251 Blackwood. Has a risk assessment been carried out.
If so what date and what safety measures have been put forward in relation
to the proximity to the road.
 
We confirm that we hold the information you have requested and it is

Under Exception 6(1)(b), we are not required to provide information in
response to a request if the information is already publicly available and
easily accessible to the applicant in another form or format.  In
accordance with Regulation 12 of the Environmental Information Regulations
this letter acts as a Refusal Notice.
 
Please note a Risk Assessment would not be required as part of the
planning application process, and that safety fencing is proposed around
the playground.
 
Please note that we have dealt with your enquiry under the Environmental
Information Regulations 2004. Environmental information is exempt from
disclosure under the Freedom of Information Act 2000 by a Section 39
exemption. This exemption exists due to provision for access to this type
of information already being provided for by the Environmental Information
Regulations 2004. Therefore in accordance with Section 17 of the Freedom
of Information Act 2000 this letter acts as a Refusal Notice to supply
this information under the Freedom of Information Act.
