Plans to Introduce Policy for Compliance with Terrorism Law PCC (and PCP)

Kent Police and Crime Commissioner did not have the information requested.

Dear Kent Police and Crime Commissioner,

Would you please disclose your plans to introduce policy to comply with the statutory reporting duties of Terrorism Law ?

As you know both you and your supervising PCP have recently admitted that, unlike for example bodies like universities and charities, you have no policy for compliance with your statutory duties to the defence of the Realm as defined by Terrorism Law.

You will appreciate that there is also a spill over consequence represented by Criminal Law Act 1967 (Payment for concealing knowledge of crime).

You already know that of interest are Sections 38B and 54 Terrorism Act 2000 (Relating to possession of illegal firearms and training therewith in Kent). And in a related matter to the reliability history of Dungeness A concerning whether or not its resilience to terrorist attack may have been advance compromised by sabotage.

Of course, concerning firearms crime in Kent, the history has now assumed public interest importance for the Home Secretary's planned Judge Led Inquiry into the Daniel Morgan and Stephen Lawrence cases. For example the as yet unanswered question of who provided moonlight bodyguard work to Lawrence case officer(s) and was that source of work employed by an associate of a major figure in the Lawrence case ? Was that same source involved in the training of unidentified Middle Easterners with illegal uzis at Kent gun ranges ? The knowledge of such activity would be subject of the Terrorism Act 2000 for mandatory reporting to Dyfed Powys and Met Police post 9.11 inquiries which examined cases of Al Quedda suspects training at UK gun ranges with uzis.

It is now published that a notorious Kent based criminal had proffered Police assistance (which Customs were keen to pursue) to obtain a crate of illegally imported uzis to prove that such lethal illegal weaponry was being smuggled in. I would hope the Judge led Inquiry will establish police reasons for refusing to make the uzi acquisition inquiry.

Given the clear connection, between the Met Police arrests of UDA terrorists at the UDA base of operations in Margate 1992 and the Lawrence case, the history becomes even more perplexing.

As I understand your role it is to hold the Chief constable to account whilst observing your own individual statutory and Common Law reporting duties. Therein lays your problem Ms Barnes. The law places reporting duties on each of us. Maintaining silence in these circumstances is a criminal offence carrying five years imprisonment.

The question is what steps are you taking to develop policy for you and your staff (are they instructed to unlawful silence I wonder ?) to comply with the law of mandatory reporting ?

You know that IPCC recently emailed me asking how Kent Police were compromised to conduct the Lawrence Inquiry for the then PCA and Home Secretary.

Would you please be mindful in your review of the statutory reporting duties of Terrorism Act 2000.

Mr Biddiss ex Det Supt did send copies of documentation. Some relate to Russia activity of a bodyguard training company set up originally by unlawful use of Deal Royal Marines Barracks 1976 to 1983.

I would ask you to also be mindful of the Leveson Inquiry and the Mark Ellison QC review. In particular the matters which refer to the former Met Detectives who arrested UDA at Margate 1992. Two detectives left police and founded Mayfayre Associates. A private inquiry company subject of parliamentary questions to James Murdoch including about whether News Intl employed Mayfayre and whether a Lawrence case detective was a source of confidential police information channeled to News Intl that way.

This would be of interest to the Kent Police murder inquiry into the killing of Stephen Cameron. A case in which retired Det Supt Biddiss gave press a statement in response to Levenson Inquiry. That he formed a secure investigation team to protect officers from "Leaks" that put officers lives at risk.

As you know Det Supt Biddiss was also investigating the murder of retired MI5 officer Ken Speakman at Ramsgate 1996. A member of a Thanet Gun Range at which there had been complaints of unlawful paramilitary live fire training with uzis. Now of course we know that some time prior to that Kenny Noye and Customs had approached police with an offer to obtain a crate of illegally imported uzis as evidence.

It not being yet known why police refused Customs and Kenny Noye offer.

You should by now be tying this together in your own minds. Did Mayfayre employ a senior member of the above live fire training bodyguard company ? Among the documents Mr Biddiss rightly and commendably copied to your Pro Standards 3 years ago should be six pages of information from such a senior member of that bodyguard group.

You will safely infer that IF Kent Police had complied with Sir John Grugeon's call 1997 for inquiry and report that the truths of this would have come out and been properly reported to the MacPherson Inquiry. Raising too I suggest (Director records) the association of the Lawrence inquiry to the 1987 Daniel Morgan murder inquiry that has been belatedly picked up in the Mark Ellison QC Review.

This represents the basis for argument that Kent Police compounded their existing compromise to conduct Lawrence Inquiry by refusing their own Police Authority call for inquiry that was actually at the time of Kent Police conducting Lawrence Inquiry.

It has been suggested to me I should emphasise that when Standards Process at KPA under Ann Barnes Chairmanship occurred it was after reports of concern from Arms Decommissioners Good Friday Agreement and after Scotland Yard gave a press release naming men they wanted to question in their post 9.11 inquiry. For live fire training Al Quedda suspects at a Welsh gun range.

Please be aware that though Thanet District Council failed to enforce Planning law against Ken Speakman's range in Thanet Dartford Council a year later did enforce against a Dartford range on the same unauthorised modifications basis that Thanet Council had failed to enforce.

I will finish with another reminder to Ms Barnes Sections 38B and 54 Terrorism Act 2000. I am seeking advice about whether she, and a member of Kent Police Authority exempted Standards examination under Ms Barnes Chairmanship, could deploy a defence that Kent Chief constable knew what they knew. There is a Misprision of Treason aspect given Ms Barnes was sworn to HM the Q as a JP. Plus a conspiracy aspect. The essential question whether your PCC has an undischarged duty to report and whether there is a case for conspiracy, misconduct in public office and Misprision of Treason.

Kent Police should be contacting you as they have an FOI which gives an IPCC refrence number that pertains to an IPCC question about Kent Police having been compromised to conduct Lawrence Inquiry.

I suggest that Mrs Barnes should introduce a compliance policy with the Terrorism Act (Thanet Council are consulting to that end and should now be contacting Dartford Council for details of their 1996 gun range enforcement) And as soon as she is minded to stop picking and choosing which laws are to her onion chart liking then you will have an answer to this FOI. Which should include that Ann Force One has reported her knowledge to Dyfed PowysPolice and to Met Police.

Please ensure that your PCC is aware of developments. In 1982 a joint exercise between UK forces and Belgian units of Gladio was cancelled due to the Falklands War.

At the end of the Falklands War there was a mission to Belgium by the Deal Barracks based "Combat Training Team Royal Marines". You have photos of this mission showing English police officers in uniform deployed to Belgium as part of the mission. You now know that Secretary of State for Defence has denied this group had Crown Authority (Without it their activity in Kent was unlawful by UK law) and has suggested they were "Private contractors"

Hence uniformed police officers were deployed unlawfully working with a private contractor who had no Crown authority.

You also know from your records that Brigadier Mike Harvey raised a report of concern direct to MI5 in that casev relevant year 1982.

Next to the year of the Deal barracks tragic terrorist bombing 1989. The year Kent Police nil actioned all 41 lines of inquiry in security warnings on Deal Barracks (anniversary of bombing today) And refused to record all the crime complaints inherent in the 41 lines of inquiry.

Exercise Waterland 1989. Royal Marines SBS joint exercise with Gladio units Zeebrugge. And Kent channel ports ???

1990 EU resolution on member states to dismantle Gladio and all its spawn. Belgium complied (UK did not) and the Belgian senate inquiry into 29 terrorist murders threw up Deal Barracks lines of inquiry. Not pursued by Kent Police.

At the heart of this it is a Treason issue. The constable oath bound by HM the Queen's Coronation Oath. And the conditions by which the office of constable is held. The law said that the Crown is the sole authority for armed force. Police were not just condoning and protecting breaches of that law they were participating.

Ms Barnes is also sworn as a JP "To do right by all manner of people". In her role as Chair of POlice Authority and as PCC this oath has been the more observed by the breach.

Now we know she has no policy for compliance with terrorism Acts and that, unlike Thanet District Council, has decided not to have a compliance policy without even seeking legal advice.
