Plans for administration of the Weald of Kent grammar school using an annexe in Sevenoaks

Dear Weald of Kent Grammar School,

I would like to make a Freedom of Information request for information regarding the administration of your annexe in Sevenoaks, specifically your plans for operation of the school using two sites. I believe that such a proposal must have been prepared for submission to Kent County Council and/or the Department for Education.

I would expect to see plans for transport between the two sites, staffing arrangements, number of pupils travelling to make use of facilities, and other details designed to make this a workable arrangement. If financial or other details can not be provided please still send the documents but with confidential sections obscured.

Thank you for your request for information. I am responding on behalf of the Weald of Kent Grammar School. You asked for:

"I would like to make a Freedom of Information request for information regarding the administration of your annexe in Sevenoaks, specifically your plans for operation of the school using two sites. I believe that such a proposal must have been prepared for submission to Kent County Council and/or the Department for Education.

I can confirm that the School does hold information falling within the scope of your request and I am pleased to provide the attached information in response to your request.

The School does hold further information relating to plans for transport between the two sites, staffing arrangements and number of pupils travelling to make use of facilities, and other details to make it a workable arrangement, however the correspondence and documentation required an opinion to be sought as to whether the section 36 exemption under the act applied to these.

Having sought the opinion of the School's qualified person (Chair of Governors), the School's view is that the information in other records held is exempt from disclosure under section 36(2) of the FOIA as disclosure would prejudice the effective conduct of public affairs. Disclosure would undermine the scope for future free and frank exchanges of views and the scope for public authorities to cooperate together with candour. Were disclosure considered likely in such circumstances, the quality of advice and decision making would suffer.

Further work involving cooperation between KCC, the School and the Department for Education is envisaged and required in relation to the creation of the Grammar school annexe. A safe space in order to develop ideas, debate live issues and reach decisions away from external interference and distractions is needed and promotes effective decision making. Challenging discussions about areas set out in the current plans where further detailed work on delivery is required would be undermined by disclosure of the requested information at this stage.

The School recognises the public interest in disclosure of the requested material. Given the continuing work on this project, the public interest in ensuring that cooperation and decision making is as effective as possible and the belief that disclosure would seriously undermine this, the School's opinion is that the public interest in maintaining the exemption is greater that the public interest in disclosure. The School will monitor its application of this exemption and when circumstances change such that effective dialogue and decision making would not be undermined by disclosure, further disclosure will be made.
