Planning sites

Dear Ceredigion Council,

I have been told that the sloping field opposite the nursing home at the top of the Waun Fawr crossroads in Llanbadarn Fawr, Aberystwyth, is proposed to have (c.50) houses built on it, and CCC have been working with developers to build on this greenfield site.

1. Please tell me more about what the Council has been doing. What are the plans?

2. What part has the Council played? How much advice have they given? How much time has been spent on this, and at what cost? Have there been any payments to the Council? What reports and plans have been written?

3. Do any councillors or Council staff have ANY connections to any of the developers (friends, business, payments, related etc)?

4. How can people object to the Council secretly working with developers to build on greenfield sites in Ceredigion? (I say secretly because people in the area haven't been informed by the Council that this was going on).

5. Why is the Council spending so much time and expense on supporting developers building on green areas, and not spending that time and money on protecting the areas from development?

In respect of your Freedom of Information request of 15^th October 2014 ,
the Council is able to respond as follows

 

Local Development Plan (LDP) process

The site referred to is a site allocated for housing development (site
(H0304) in the adopted Ceredigion Local Development Plan (LDP). The
Ceredigion LDP was adopted on the 25th April 2013. The Plan was the
subject of a statutory process which involved consultation on the document
as a whole in 2010 (including the allocated sites) and detailed
examination during 2012.

 

The site was put forward by an agent on behalf of the landowner as part of
the initial stages of LDP preparation (7th March 2008 – 2nd May 2008).
This was the candidate sites consultation stage where the LPA, as required
by legislation, call for sites to be put forward for consideration in
terms of their suitability for inclusion in the LDP for development. The
site was subsequently referred to as candidate site S0836 – Land at
Primrose Hill/ Tir yn Primrose Hill, Llanbadarn Fawr until assessments had
been completed. The site was included by the Council as a proposed
allocation in the Deposit Version of the Plan at December 2010 as site
H0304. The Deposit Version was the subject of public consultation during
early 2011, which provided the public with the opportunity to comment on
the Plan as a whole, its proposals and allocations. The plan and this
allocation was subsequently the subject of a public Examination, which is
a statutory part of the process in adopting a LDP..

 

The site has therefore been fully assessed and considered throughout the
LDP process and by an independent Inspector has concluded the site as
being suitable for housing development. The LDP process included
deliberation of areas that needed protecting as well as deliberation of
where new development should be accommodated. An application at this
location, subject to meeting the site specifics cited in the LDP (see
details set out in Volume 2A of the LDP) and plan policies generally (see
Volume 1 of the LDP), is likely to lead to a permission being granted due
to its allocated status. Therefore the potential use of the site has been
established through the LDP.

 

Pre-application discussion

In terms of the planning application, it is good practice for applicants
to approach a LPA prior to bringing in a planning application to discuss
their proposals with Officers. This allows an exchange of information to
ensure that an application eventually submitted is the best scheme and
meets the requirements of the LDP. This planning practice is referred to
as the pre-application stage and its purpose is to ensure that the
applicant is aware of any specific site requirements, specific surveys
required etc. Applications that have not been the subject of a pre
application could get refused due to the application containing
insufficient information for a positive determination to be given. This is
a practice used across most LPAs and is likely to become compulsory as
part of the new Welsh Planning Act which is currently going through the
Assembly scrutiny process. Currently there is a standard fee for
pre-application advice within Ceredigion of £40. Other costs to the
Council are normal costs associated with dealing with planning
applications and are not calculated separately.

 

Consultation:

In terms of consultation in relation to the LDP, this occurred in relation
to the LDP at various stages in developing the LDP. Adverts were placed in
the press and site notices were erected on allocated sites. Those who
objected to the allocation at that time had the right to be heard at
Examination by an independent Inspector. Only one representation was
received with regard to this site, that came from the landowner’s agent
who objected to some of the specific requirements set out in the LDP. The
landowner’s agent attended Hearing Session 8 on 2nd October 2012 to have
their case considered.

 

In terms of consulting on the planning application, the application was
widely advertised as part of the determination process. In accordance with
regulations the application was advertised as follows:-

•           18 September 2014 – Notification to neighbouring properties
(within 50m of the site) and to statutory consultees;

•           26 September 2014 – Site notice erected

•           02 October 2014 – Press notice in Cambrian News

All notices gave a period of three weeks to respond with any comments
however as with the practice of the Local Planning Authority all
correspondence received after the cut-off date will still be taken into
consideration provided that the application is still alive. To date the
LPA have had 27 objections with one 9 signatory petition objecting the
proposal

 

The LPA have applied the correct procedures and have applied them
transparently  both in discussion with the applicant and in terms of
consultation both with regard to the planning application itself and the
LDP process prior to that.

 

Other procedural points:

A pre application meeting was held with the applicants’ agent  together
with both Planning Policy officers and Development Management officers to
discuss particulars of submitting planning application on this allocated
parcel of land. The meeting was held on 16th July 2104.

 

The planning application file is public information and is available to
view at the Council Offices, Penmorfa, Aberaeron.

 

A report gets written by the Case Officer once all the information needed
(consultee responses etc) have been received and a decision can be made.
The report sets out the case, the various considerations and the
conclusions (approve/refuse).

 

The Council has a code of conduct which all Officers and Members are
required to follow in relation to all lines of work which they are
involved in. This is to avoid Officers or Members being involved in
matters where they have a specific defined interest.

Dear Huw Evans,

Q2: there is no costing of all the staff time spent on this location. Mention of the reports etc show that the Council has spent significant staff time working on it, but this is not addressed.

Q3 is not answered properly. I wasn't told which staff have connections and what they are.

The Council has not explained why it is working to get housing built there (e.g. by putting it into the LDP, which is not a document with a public mandate, is outdated, and is mostly just a renamed version of the UDP which was thrown out by Government). The LDP does not justify building there.

Further, this response mentioned planning notices going up, but I have been informed that this is fabrication, and there has yet to be a planning application there. From the information I received it does sound like you are talking about a totally different development, which means this response is giving false information.
