Planning requirents for Residential Children's Homes
Dear Barking and Dagenham Borough Council,
I am writing to you under the FOI Act 2000.
My request is as follows.
In light of Communities and Local Government Circular 08/2010,
specifically Annex A Paragraph 5, "DWELLINGHOUSES AND HOUSES IN
MULTIPLE OCCUPATION – GUIDANCE ON CLASSES", which states, "It
remains the case that in small residential care homes or nursing
homes, staff and residents will probably not live as a single
household and the use will therefore fall into the residential
institutions class (Class C2), regardless of the size of the home.
Local planning authorities should include any resident care staff
in their calculation of the number of people accommodated", please
answer the following.
1. Is is permissible by Thanet District Council to operate/use a
premisses that currently holds C3 Domestic dwelling status, as a
residential children's home as regulated by Ofsted and other
regulatory bodies and acts?
2. State all permitted use changes with premisses that currently
hold C3 Domestic dwelling status, i.e. changes that do not require
planning permission.

in any way please feel free to email me. If some parts of this
request are more difficult to answer than others please release the
answerable material as it is available rather than hold up the
entire request for the contested data.

1. Is it permissible by London Borough of Barking and Dagenham to operate/use a premises that currently holds C3 Domestic dwelling status, as residential children's home as regulated by Ofsted and other regulatory bodies and acts?
It is potentially possible that a C2 use would not require permission if it is not materially different in its characteristics from a C3 dwelling house. This would need a detailed analysis of the use to understand the amount of comings and goings etc.
2. State all permitted use changes with premises that currently hold C3 Domestic dwelling status, i.e. changes that do not require planning permission.
On the second point, it is not possible to provide a definitive answer, nor is it within our gift to do so, the Use Classes Order and permitted development rules emanate from Government and there application is also affected by case law, but you may be aware for example that currently it is possible to change to C4 use without requiring permission.
